• PO10 - the operation of the proposed visitor accommodation will not result in the parking
of buses or other vehicles within low level residential streets including Resort Drive;
• PO11 - safe vehicular access is provided to and from the site without adversely impacting
on the safety of the road network (discussed below);
• PO12 - sufficient onsite car parking is provided to accommodate the number and type of
vehicles likely to be generated by the visitor accommodation having regard to the number
of guests, staff, and visitors attending the integrated Resort Complex as a whole (discussed
below);
• PO13 – the visitor accommodation is provided with a level of infrastructure and services
that:
o are appropriate to its location and setting;
o will maintain environmental and public health; and
o are commensurate with the needs of users.
The proposed Resort Complex is consistent with the relevant performance outcomes under the
Visitor Accommodation Code. The proposed visitor accommodation is appropriately located,
designed, and will be operated in a manner which meets visitor needs, protects, and enhances
landscape values. Further, will protect the amenity of surrounding premises and will not conflict
with surrounding uses. To the extent there is any inconsistency with the Visitor Accommodation
Code, conditions can be imposed to achieve compliance. Further, on balance, there are a number
of relevant matters for which discretion should be granted.
Business Uses Code
The proposed development includes a café and bar (Food and Drink Outlet) as part of the Resort
Complex as would be reasonably expected. It is expected that the café and bar will be primarily
used by guests of the “Boutique Hotel” however, other non-staying visitors might attend the site
at times. The scale of the café and bar is about 100m² and will remain ancillary to the Resort
Complex.
The most relevant overall outcomes under the Business Uses Code are discussed briefly below:
• the business activities are ancillary to the Resort Complex and are consistent with the
Noosa Shire Centres Hierarchy (OO(a));
• the proposed business activities are designed and sited in a manner that responds to the
zone and locality in which they are located, streetscape characteristics and surrounding
land uses (OO(b));
• the business activities are not located or expected to be located within a centre (OO(c));
• the proposed business use is of a type, scale, and intensity suitable for the location,
surrounding development and character of the area (OO(d));
• the site layout, building design and landscape treatments provides efficient and safe
conduct of business activities, vehicle access and manoeuvrability (OO(e));
• the building design is of a low key human scale and responds to Noosa’s subtropical
climate (OO(f));
• the proposed development integrates with natural landforms and landscape features
(OO(g));
• the business activities are well removed from other residential properties and can
adequately manage potential negative impacts such as noise, privacy, lighting on
residential land uses (OO(h)); and
