EXECUTIVE SUMMARY
The current policy governing the administration of tenure to community organisations on
Council owned or controlled land is the ‘Interim Tenure Policy for the Community Use of
Council Owned and Managed Infrastructure’ which was endorsed by Sunshine Coast
Regional Council on 10 December 2009. In accordance with the Local Government (De-
amalgamation Implementation) Regulation 2013 this policy subsequently transferred to the
new Noosa Council.
The policy did not fully address the tenure responsibilities of community organisations and
Council and was implemented as an interim measure to provide some certainty to
community organisations until a more comprehensive policy was developed.
The Community Purpose Land and Infrastructure Tenure Policy (draft attached) is proposed
to replace the existing policy. The policy is largely based on the previous Noosa Council
policy adopted by Noosa Council in 2005. A comparison table of the previous Noosa Council
policy and the proposed policy is attached for reference. The main provisions of the
proposed policy are:
1. Tenure Periods - Community tenure arrangements on Council freehold land or trust land
will include short term permits up to three years or five to ten year leases.
2. Land and Infrastructure Renewal and Maintenance Expenses – all new tenure
arrangements will specify the tenure holder as solely responsible for the costs of
maintaining, repairing and replacing improvements and existing grounds and facilities
within the tenured area unless otherwise agreed.
3. Land and Infrastructure Operating Expenses - all new tenure arrangements will specify
the tenure holder as solely responsible for all charges in relation to the tenured area.
This includes costs such utility charges, telephone / communications, trade waste and
pump outs, and Council issued rates, levies and charges.
4. Insurance - all new tenure arrangements will specify the tenure holder as solely
responsible for acquiring public liability insurance and adequate building, contents
insurance and all other insurances as required.
5. Tenure Establishment Costs - costs associated for the establishment of tenure will
usually be borne by the applicant. These include lease preparation, survey fees and
document registration.
6. Rental amounts - nominal rental will be payable for community organisations which
occupy Council owned or controlled land and infrastructure under a tenure arrangement
with Council.
