The applicant has maximised the amount of development able to be located within the
Tourist Accommodation Zone; however, because of the existing development, the
proposed development must extend into the Recreation and Open Space Zone. This is also
because of the agreed location of the 2.5 ou contour, this being the acceptable odour
nuisance level from the Waste Water Treatment Plant (WWTP). Further, it is also desirable
to locate two (2) of the proposed tennis courts within the Tourist Accommodation Zone to
retain koala habitat on the site.
It is unclear why the Tourist Accommodation Zone was located over land that contained
the existing facilities, given there is a clear intent to provide a Resort Complex on the land
under the Noosa Plan 2020. Further, this zone is also constrained by the odour contour as
shown in Figure 1, below.

b. While it is accepted that a Resort Complex is an inconsistent use in the Recreation and
Open Space Zone, under performance outcome PO7 of the Tourist Accommodation Zone
Code, the subject land (all of Lot 4 on SP178340) has been specifically identified as being
intended for a Resort Complex, which is being proposed. There are several relevant matters
that are relevant to the assessment, which suggest approval, despite any technical non-
compliance with the Recreation and Open Space Zone. Further, two (2) of the proposed
tennis courts could have been located within the Recreation and Open Space Zone, which
is a relevant consideration.
c. The proposed development is not an overdevelopment of the site, for the following
reasons:
