ORDINARY MEETING AGENDA 2 JANUARY 2014
6.7 INFRASTRUCTURE CHARGES RESOLUTIONS AND POLICIES
DOCUMENT INFORMATION
File No ECM/Subject/Infrastructure Charges
Author Priority Infrastructure Planning & Infrastructure Charges Officer
SUMMARY/PURPOSE
Under “The Local Government (De-amalgamation Implementation) Regulation 2013”, the current
infrastructure charges resolutions and policies adopted by the Sunshine Coast Council transfer
and continue to apply to The Noosa Plan planning scheme area until such time they are reviewed
and replaced by new resolutions and policies adopted by the new Noosa Council.
This report presents a proposed amendment to the current Sunshine Coast Council resolutions
and policies for Noosa Council’s consideration to remove the development incentives (build and
benefit) policy.
A further report will be presented for Noosa Council’s consideration at a future meeting on
Infrastructure Charge Resolutions and Policies for Noosa.
BACKGROUND INFORMATION
The legislation governing how new development should contribute to local government
infrastructure through infrastructure contributions and charges has been under constant change
over the last 10 to 15 years.
Prior to 1997, conditions were generally imposed on development approvals requiring specific
works or monetary contributions as assessed at the time by Council or through local planning
policies and headworks policies in the case for the water supply and sewerage networks.
The “Integrated Planning Act 1997” (IPA) introduced requirements for new Planning Scheme
Policies (PSPs) and required a Schedule 3 planning scheme process that included public
consultation prior to formal adoption by Council. These Planning Scheme Policies (PSPs)
specified the amounts, method and applicable areas in which development were to contribute to
the specified infrastructure networks. Conditions contained in development approvals for Material
Change of Use and Reconfiguring a Lot applications specified compliance with the Planning
Scheme Policies (PSPs) and other reasonable and relevant requirements such as development
frontage works or connection works to the infrastructure networks.
The “Integrated Planning Act 1997” (IPA) legislation also brought in Infrastructure Charges Plans
(ICPs) for “trunk” infrastructure networks to replace the former contribution schemes. These
plans were required to undergo the full Schedule 1 planning scheme process involving first and
second State Interest Reviews in addition to public consultation before final adoption and gazettal
by Council. The former Noosa Council was the only local government to have an Infrastructure
Charges Plan (ICP) approved by the State Government, adopted and implemented in
Queensland being the Noosa “Coastal Major Road Network Infrastructure Charges Plan”
(CMRNICP) that commenced in June 2004. In contrast to application of Planning Scheme
Policies (PSPs) through conditions contained in development approvals, infrastructure charges
are issued through separate charge notices when triggered by a development approval for
Material Change of Use, Reconfiguring a lot and Building Works. These infrastructure charges
apply as a “rate” against the property in accordance with the legislation.
