PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 10 OCTOBER 2017 RECOMMENDATION That Council note the report by the Development Planner to the Planning & Environment Committee Meeting dated 10 October 2017 regarding Application Nos. REC17/0021 for a Preliminary Approval to Reconfigure a Lot (Boundary Realignment) and MCU16/0130 for a Development Permit for Material Change of Use for Retail Business Type 6 – Hardware, Retail Business Type 7 – Garden & Lifestyle Centre, Commercial Business Type 1 – Office, Industrial Business Type 2 – Production, Alteration, Repackaging and Repairing, situated at 101 and 105 Eumundi Road, Noosaville and: A. Issue a Preliminary Approval to Reconfigure a Lot (Boundary Realignment) in accordance with the following conditions: PLANNING Preliminary Approval 1. Prior the issue of a Development Permit, the following documentation must be submitted to Council for review and approval: A plan of survey prepared by a suitably qualified person generally in accordance with Drawing No. 04, Revision B, Site Plan prepared by Epoch Architecture dated 27/05/17. B. Refuse a Development Permit for Material Change of Use for Retail Business Type 6 – Hardware, Retail Business Type 7 – Garden & Lifestyle Centre, Commercial Business Type 1 – Office, Industrial Business Type 2 – Production, Alteration, Repackaging and Repairing for the following reasons: 1. The proposed development is inconsistent with The Noosa Plan’s zoning intent for the site for multiple housing forms which retain a high level of residential amenity, design quality and safety; 2. The proposed redevelopment of the site will result in an intensification and expansion of commercial and industrial uses in area which is intended to be developed for multiple housing and the site ought to be redeveloped consistent with the site’s residential zoning intent; 3. The proposed uses are more appropriately located in the nearby Business Centres and the Noosaville Industrial area; and 4. The application has not demonstrated sufficient grounds to justify the conflict with the planning scheme as the application has not demonstrated a significant need for the proposed uses. The site is more appropriately developed for multiple housing forms, consistent with Council’s recent Housing Needs Assessment which indicates a need for additional residential dwellings, particularly smaller dwelling types. REPORT 1. PROPOSAL Reconfiguration of a Lot (Boundary Alteration) The application seeks approval for a Preliminary Approval to Reconfigure a Lot (Boundary Realignment). The reconfiguration relates to the realignment of the common boundary of 101 & 105 Eumundi Noosa Road and intends to create two rectangular shaped lots. The applicant suggests the realignment removes the irregular boundary allowing for proposed Lot 101 to better accommodate the proposed Material Change of Use while increasing the usability of Lot 105 to accommodate a future residential use. The applicant seeks a preliminary approval only on the basis that a properly prepared plan of survey was unable to be provided at the time the application was submitted. Page 63 of 128
