This application is lodged following feedback and request from Council on 20 May 2024 (e-mail from Morgan
Gaffney, Senior Engineer – Development and Regulation).

We, BDH Group Investments Pty Ltd, the owner of 170 Eumundi Noosa Road, and 174 Eumundi Noosa Road,
request the following in relation to OPW22/0052.02 Decision Notice;

    • Remove Condition 3 in its entirety

    • Remove Bornhorst & Ward as the addressee of the notice and replace with BDH Group Investments Pty Ltd
        (Bornhorst & Ward are no longer involved in the project, with Black and More taking over as Consulting
        Engineers)

    • Remove any reference to Bornhorst and Ward drawings from the notice (Bornhorst & Ward are no longer
        involved in the project, and new drawings prepared by Black and More were provided with the previous
        submission)

Whist we are submitting a revised application as requested, we do not understand why this action requires a new
application. Council has been aware of our plans to complete only the proposed Operational Works required to
complete the approved realignment of our lots. No other development works or building is proposed at this stage.

The background to this application is as follows;

Realignment Approval – RAL 17/0502

Our application to realign lots 170 Eumundi Noosa Road and 174 Eumundi Noosa Road was lodged in July 2017.

The realignment will create a larger lot rather than the space being spread over two lots, and will allow greater
flexibility regarding future developments.

The realignment application was approved on 1 February 2018, subject to various conditions regarding Stormwater
Drainage, Retaining Walls, Provision of Services, and Registration of relevant Easements.

On 19 December 2023, the currency period of the approval was extended to 1 March 2026 (RAL 17/0502.2).

Operational Works Approval – OPW 22/0052

An Operational Works Proposal was submitted in March 2022.

This submission was for a development being proposed for a Tyre Company and the Consulting Engineer was
Bornhorst & Ward.

As the Operational Works related to a complete development, the drawing pack included a Car Park layout.

Unfortunately, the project was not commercially viable, so the build did not proceed.
