First Minor Change to Operational Works Approval – OPW 22/0052.01

Following our decision to not proceed with a complete development, we submitted a minor change application in
November 2023 (via previous engineers Bornhorst + Ward) that would facilitate the works required to achieve
realignment of the Lots.

To be clear – the main reason for the minor change is to get us to a position where we can reconfigure the lots.

The minor change application showed only earthworks, retaining walls, services etc required by the Realignment
Conditions.

The drawings we submitted in this application did not show any carparks as there would not be any carparks
constructed. This would be evaluated in any future development submission.

The decision notice was received on 10 January 2024.

Condition 3 and drawings C0850 and C0860 relating to the Carpark remained in place from original Operational
Works submission.

We wrote to Mark Lewis (email attached) asking why this condition was still in place and whether it needed to be
removed. Mark indicated that he didn’t believe there were any issues with the approval retaining the condition
and that it would not impede the reconfiguration of the lot.

Based on this advice, we did not take any further action.

Second Minor Change to Operational Works Approval – OPW 22/0052.02

In March 2024, we engaged Black and More Engineers to manage the approved Operational Works for us. On
review of the plans, they noticed that the plans prepared by Bornhorst & Ward could be improved. Following
discussions with Council, it was advised that a minor change application would be required to approve the
changes.

The Minor Change was submitted on 11 April 2024 with a new set of six drawings prepared by Black and More.
These drawings related to Earthworks, Retaining Walls and Drainage, and as with the First Minor Change, do not
show any carparking or building works.

These drawings replaced all drawings previously prepared by Bornhorst & Ward.

The Minor Change was approved on 2 May 2024.

Summary

The purpose of this Operational Works is to satisfy the associated boundary realignment and plan sealing

We do not intend to construct any buildings or carparks as part of these works.

Therefore, based on advice received from Council on 20 May 2024 (email attached), we will need to have
Condition 3 and the Bornhorst + Ward drawings C0850 and C0860 removed from this Op Works decision notice via
this minor change application.

We intend to begin construction in June 2024.
