DELEGATE DESCRIPTION OF POWER DELEGATED LEGISLATION ADOPTED BY CONDITIONS TO WHICH

SUBJECT
Chief Power, as the employer, to give notice to the employee of the Section 84 Industrial
Executive day on which the employee must return to work and, if the Relations Act 2016
Officer employee returns to work, to cancel the rest of the parental
leave.
Chief Power, as the employer of an employee whose present work is, Section 89 Industrial
Executive because of pregnancy or breastfeeding, a risk to the health or Relations Act 2016
Officer safety of the employee or their unborn or newborn child, to:
(a) temporarily adjust the employee’s working conditions or
hours of work, or
(b) transfer the employee to other appropriate work; or
(c) In the circumstances in subsection 89(5), grant the
employee birth-related leave, or any available paid sick
leave.
Chief Power, as the employer of a replacement employee, to give the Section 92(1) Industrial
Executive replacement employee written notice of the temporary nature Relations Act 2016
Officer of the employment and the parent’s right to return to work.
Chief Power, as the employer, to agree when an employee is to take Section 97(2) Industrial
Executive long service leave. Relations Act 2016
Officer
Chief Power, as the employer, and where the employer and employee Section 97(3) Industrial
Executive cannot agree when the employee is to take long service leave, Relations Act 2016
Officer to decide when the employee is to take the leave and give the
applicable notice to the employee.
