EXECUTIVE SUMMARY
Not applicable.
RECOMMENDATION
That Council note the report by Property Officer, Property and Land Management to the Planning
& Organisation Committee dated 25 March 2014 and approve the transfer of the Noosaville
Slipway sub-lease to Ross Blair and Peta Cave, trading as Noosa River Slipway, and seek
Ministerial consent for the transfer as required under section 322 of the Land Act 1994.
REPORT
The current sub-lessee of the Noosaville Slipway (known as the ‘Mill Street Slipway’) has sold the
business operating from the slipway. The sale is conditional on the sub-lease being transferred to
the new business owner. The lease is not due to expire until the 6th September 2022.
Background
Noosa Council entered into a 20 year lease agreement for 4 Mill Street, Noosaville with the
Department of Natural Resources Management (DNRM) on 1st May 2005. It was agreed (subject
to the Minister’s consent) that Council would sub-lease a part of the land as a slipway, which was
subsequently approved with the sub-lease commencing on 7th September 2007. Noosa River
Services Pty Ltd has operated a boat repair business from the slipway under the sub-lease
arrangement.
In order for Council to consent to the assignment of the lease for the future operation of the
slipway, Property and Land Management (PLM) requested that the current sub-lessee supply
Council with the proposed assignee’s details, and the assignee was required to provide
references and financial information to allow an appropriate evaluation of the assignee’s suitably
to hold the interest or right to sub-lease the slipway. These documents were received and
assessed, with the assignee Ross Blair and Peta Cave, owners of registered business Noosa
River Slipway, deemed suitable to hold the slipway sub-lease.
A deed of assignment is to be executed by the current sub-lessee, the assignee and Council.
Once a Council resolution has been obtained, Ministerial consent is also required prior to
lodgement of the transfer of sub-lease for registration in accordance with section 322 (1) (a) & (b)
of the Land Act 1994.
