Notwithstanding, many of the smooth barked gum species, including flooded gums are located
outside of the clearing footprint and are associated with the gullies, although some flooded gums
are present to the west of the proposed residence.
While the proposed residence and larger shed does not intersect mapped koala habitat, the
residence’s asset protection zone and the proposed clear zones around the sheds do encroach
into mapped core koala habitat. The stockpile areas south of the residence do not intersect
mapped koala habitat.
Reference to Schedule 10, Part 10, Division 3, Subdivision 1, Section 16AB of the Planning
Regulation 2017 states that development is assessable where it involves interfering with koala
habitat in koala habitat areas outside of koala priority areas, however this does not apply to the
extent the development is exempted development.
Reference to Schedule 24 of the Planning Regulation 2017 indicates that the clearing of native
vegetation can be progressed as exempted development for the following extents:
• Item k) 500m2 for development subsequent to 7 February 2020
• Item n (vii)) development that is or involves operational work that is the clearing of native
vegetation in a koala habitat area if the clearing is necessary for essential management.
Reference to Schedule 24 of the Planning Regulation 2017 indicates that essential management
means clearing native vegetation—
(a) for establishing or maintaining a necessary firebreak to protect infrastructure, other than a
fence, road or vehicular track, if the maximum width of the firebreak is equal to 1.5 times the
height of the tallest vegetation next to the infrastructure, or 20m, whichever is the wider.
Schedule 6, Section 20A states that operational work that is clearing native vegetation if the
clearing is necessary for establishing or maintaining a necessary firebreak to protect
infrastructure, other than a fence, road or vehicular track, and the maximum width of the
firebreak is equal to 1.5 times the height of the tallest vegetation next to the infrastructure, or
20m, whichever is the wider is development unable to be made assessable under a local planning
instrument.
An existing shed is present within the cleared area between the proposed location of the
residence and new large shed. The site investigation confirmed the presence of a 42m tall,
600mm DBH Corymbia intermedia (pink bloodwood), located approximately 32m north-west
from the existing structure (-26.3307706, 152.8983045)(refer to Plate 6). This was one of a
number of tall trees assessed in proximity to the existing shed present on the property using a
digital clinometer and measuring tape and accounted for the tallest tree (although others
measured were also around 40m in height).
