SERVICES & ORGANISATION COMMITTEE MEETING AGENDA 11 JULY 2017
To respond to the above key factors, it is proposed to retender the project in the period from July
to November 2017 under the expression of interest (EOI) process. This process will seek to
shortlist only capable and experienced contractors ahead of a subsequent process of seeking
formal tender responses with pricings. Whilst the EOI process will exceed the timing of a
traditional open market process (including the evaluation process), it does have benefits to
Council that will allow:
Assessment of the capacity and capability of contractors up front.
Provide greater confidence to industry that competition is among similarly capable
contractors post shortlisting.
Allow Council to determine better value for money options from the shortlisted contractor
submissions.
The likely period for construction will be between 1 February 2018 and 14 December 2018,
avoiding Queensland School holidays, with more detail to be provided following the outcome of
the EOI and subsequent tender process.
This report is brought to Council on the basis that under the Local Government Regulation (2012)
s.228 subsection 3;
‘…the local government may invite expressions of interest under subsection (5) only if the
local government –
(a) Decides, by resolution, that it would be in the public interest to invite expressions of
interest before inviting written tenders; …’
And subsequently under s.228 subsection 6;
‘If the local government invites expressions of interest under subsection (5), the local
government may –
(a) prepare a short list from the persons who respond to the invitation for expressions of
interest; and
(b) invite written tenders from those persons.
Previous Council Consideration
Ordinary Meeting Minutes, 30 July 2015, Item 2, Page 4
That Council note the report by Project Manager and Designer - Projects to the Infrastructure &
Services Committee Meeting dated 21 July 2015 and
A. Approve the objectives for the project as set out in the report;
B. Note that staff will re-establish the Project Reference Group used for the previously
constructed stages of the Park Road Boardwalk; and
C. Authorise staff to engage with the Project Reference Group to further develop concept
designs and to bring those designs to a future Council meeting prior to proceeding to
detailed design.
Finance & Risk
The budget allocation for the project will carry over to the 2017/2018 financial year.
Noting the large tender price variances, staff will seek an independent cost estimate to verify a
second opinion on the reasonable cost for the project.
The previous open market tender process did not eventuate with a contract award due to
unacceptable contract risks. The EOI process will provide greater information to tenderers on
capacity and capability requirements.
