3.8 Land tenure and use agreements
                                                                   A
Land tenure defines the conditions under which land or
buildings are held or occupied, and can influence the
activities of clubs providing opportunities for participation in
active recreation pursuits.
Foreshore land along the Noosa River is owned by the
Queensland State Government, with Council as the Trustee.
Land tenure is administered in accordance with the Land
Act 1994 (Queensland), the Local Government Act 2009
(Queensland), and the Native Title Act 1993 (Commonwealth).
The Land Act outlines the processes to be undertaken when
dealing with State Land. There are several options for tenure,
including:
†† lease over land for, typically, a term of years
†† issue of a permit allowing occupation of land on a short-
    term basis
†† issue a licence allowing land to be used in specified ways
†† reserve the land for community, forest or conservation
    purposes
                                                                   B
†† dedicate the land as road
†† retain the land as unallocated State land
†† sell the land.
Securing appropriate tenure over land provides sport clubs
with security, and is often a requirement of funding bodies,
particularly for grants aimed at funding capital works or
significant asset purchases.
From the community’s perspective, tenure arrangements
provide clarity regarding use of public land and displays
considered and transparent decision-making.
Several of the tenure options described above are utilised in
the Noosa LGA. Those relevant to organisations or sites that
are the subject of this project are summarised in the table
below.

The Noosa River foreshore reserve is a narrow strip
of state government owned land providing access to
the waterway by residents and visitors for a range of
activities. There are several locations on the foreshore
that are leased or permitted for commercial activities,
and community organisations. The foreshore has been
developed for recreation use with typical playground and park
embellishments. Continuous pathways provide easy walking
and cycling access along the length of the foreshore.
                                                                   A. Approximate NYRC lease area boundary
