Key aspects of the existing approval conditions include:

    •    Condition 8 i) and ii) have been reproduced from the Liquor Regulation 2002. Sections 2.2
         and 2.3 below provides legislative context for the noise criteria presented in these
         conditions.
    •    Conditions 8 i) and ii) have now expired, as these conditions are stated to be replaced by
         Condition 8 iii) and iv) after a period of 12 months commencing 22 May 2020.
    •    Specific noise limits detailed in Condition 8(iii) and (iv) were adopted from the findings of
         a previous acoustic report prepared for Sunshine Beach SLSC. Based upon the noise limit
         frequency weightings detailed in these conditions, the previous report is believed to have
         been completed in accordance with OLGR’s Guideline 50, which was superseded by
         Guideline 51 in 2019 (the latest revision of the document, 2.2, is dated 03 November
         2020).
    •    The preamble to Condition 8 in addition to Conditions 9 to 11, all relate to the use of a
         sound limiting device to ensure amplified noise does not exceed the conditioned noise
         limits.


2.2      Liquor Act 1992
The Liquor Act 1992 provides a definition for ‘unreasonable noise’. The Act states:

         unreasonable noise, in relation to licensed premises, means noise that—

         (a) exceeds the limits (if any) prescribed by regulation; or

         (b) contravenes a compliance order that applies to the premises; or

         (c) contravenes a condition that applies to the licence or permit for the premises.

The Liquor Regulation 2002 details specific noise limits, which constitute unreasonable noise if
exceeded.


2.3      Liquor Regulation 2002
The Liquor Regulation 2002 states within Section 40:

         For the definition unreasonable noise in section 4 of the Act, the limits for noise are as
         follows—

         (a) between 6a.m. and 10p.m.—the adjusted maximum sound pressure level LA10, plus
         adjustments for tonal and impulse components, exceeding the background level LA90 by
         more than 10dB(A);
