REPORT
1. Purpose
The purpose of this report is to seek Council endorsement to issue new five year Commercial High
Use permits to conduct approved commercial activities on Council controlled land commencing 1
July 2021.
2. Background
Council allows limited commercial use of public land under its control in accordance with its
Commercial Use of Community Land Policy. Existing Commercial High Use permits are focussed
around the Noosa Main Beach precinct and are due to expire on 30 June 2021 (with the exception
of one iconic lifetime permit held by Hey Bill). Council resolved to proceed to tender for new permits
at its Ordinary Meeting in February 2021.
3. Tender Process
Council prepared and called for public tenders in accordance with the Local Government Act 2009.
The tender was released via VendorPanel on 3 March 2021, and advertised in Noosa Today on 5
March 2021, with the tender period closing on 6 April 2021. Respondents could submit for multiple
permits but the tender provisions noted a maximum of two permits would be awarded to any one
party. The tender material was accessed by 94 parties through the portal.
4. Tender Assessment
The tender evaluation panel undertook an assessment of nineteen (19) conforming tender
submissions received from fourteen (14) businesses (detailed in Table 1 below). Two additional
submissions were received and assessed as non-conforming and were not considered.
The conforming tenders were evaluated using the following criteria and weightings:
Evaluation Criteria Weighting
Track Record and Past Experience 50%
Current and Future Capital Investment 15%
Activity Management Plan 15%
Environment and Sustainability Initiatives 5%
Contribution to Local Community and Economy 15%
To support and monitor the tender process, Preston Law were commissioned as independent probity
advisors. Refer Attachment 10 – Probity Advisor Report.
Table 1 below summarises the results of the assessment and identifies:
The permit activities offered;
The respondents for each activity;
The current permit holder (CPH); and
The evaluation panel’s recommendation for the new permittees for 5 year permits commencing
from 1 July 2021.
