GENERAL COMMITTEE MEETING AGENDA 17 MAY 2021

there have been no significant compliance issues regarding the permit holder’s performance over
the term.
Snacks and Drinks Refreshment Van – Noosa Spit
Council received two submissions for this activity.
Kiwi Fish Pty Ltd’s submission demonstrated relevant experience and capacity to undertake the
activity, showed a higher level of business planning and professionalism and greater level of detail
in relation to the proposed new refreshment van and offerings. The business has successfully
operated an existing retail store for eleven years in Hastings Street and demonstrated strong
business acumen and understanding of the needs of the activity. The assessment panel
recommends Kiwi Fish Pty Ltd be offered the new permit for the Noosa Spit Refreshment Van.
Surf Dancing – Noosa Main Beach West
Council received one submission for this activity from the existing permit holder Surfdancer Pty Ltd.
The respondent demonstrated a high level of understanding, planning and competence across the
assessment criteria and is recommended to be offered a new permit. The business has provided a
professional service to the community over the previous permit term and there have been no
significant compliance issues regarding the permit holder’s performance over the term.
Beach Massage – Noosa Main Beach
Council received one submission for this activity from the existing permit holder, Amanda Obara,
who was first awarded the permit in 2017.
The assessment panel noted the incumbent has been observed to deliver an improved look and feel,
professionalism and level of service for this permit activity over the previous term. There have been
no significant compliance issues regarding the permit holder’s performance. The submission
demonstrated a high level of experience, organisation and professionalism as the existing operator
and is recommended to be offered a further permit.
Kite Surfing Lessons – Noosa River Mouth
Council received one submission for this activity from the existing permit holder, Tarr’s Enterprises
Pty Ltd (trading as Adventure Sports Kitesurf Australia).
The respondent demonstrated a high level of knowledge, planning and competence across the
assessable criteria and is recommended to be offered a further permit. The business has provided
a professional service to the community over the previous permit term and there have been no
significant compliance issues regarding the permit holder’s performance over the term.

5. Consequential Amendments to Council Policy
As previously acknowledged, the new Commercial High Use Permits are now offered for 5 year
terms and this is a variation to Council’s existing policy, which includes the previous permit terms of
3 years. Given the change, it is recommended a future report to Council be considered by detailing
an amended policy. As part of these amendments it is also recommended Council consider listing
the agreed permit activities policy to provide greater certainty and transparency for the community.
Previous Council Consideration
Ordinary Meeting, 18 February 2021, Item 7, Page 12
That Council note the report by the Property Advisor to the Services & Organisation Committee
Meeting dated 9 February 2021 regarding Commercial High Use Permits and agree to proceed to a
public tender process for new permits based on the proposed permits, fees, terms and assessment
criteria detailed in the report.
Finance
Permit fees proposed as part of the 2021/22 budget will seek to fund permit administration costs
throughout the term and achieve a fair return for the community.
