PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 7 FEBRUARY 2023

The site is within the Tourist Accommodation Zone where a Food & Drink Outlet is Code Assessable along
Gympie Terrace.
The applicant has requested a reduction of fees as the proposed use is within an existing building and has
a floor area of less than 100 m². The applicant further states that the development is entirely consistent with
the Tourist Accommodation Zone in this location and is fully compliant in terms of the provision of carparking.
There is minimal assessment required as there are no built form changes. It is therefore recommended that
the minor change fee be applied.

                                                                         $2561.50
An application has been lodged for a Dwelling House in the Low Density Residential Zone in Peregian
Beach. The dwelling house has various areas of noncompliance which include site cover (51%), setbacks
(two sides) and less that 75% eaves (51%). This triggers a RAP (Referral Agency Planning).
The application was lodged on 9 September 2022 and loaded as a RAB (Referral Agency Building). The
applicant paid the relevant fee.
The applicant is requesting that the RAB fee be applied due to the minor nature of the non-compliances and
due to the delay caused between the internal referral. The applicant further advises that the non-
compliances were identified at time of lodgement and they were not advised it needed to be assessed by
Planning until 4 October 2022.
The applicant further states that the decision of which section should assess the application within Council
should have no bearing on the applicant. The delays have caused considerable cost increase associated
with the construction of the dwelling.
The applicant further quotes the fees charged by other Councils and requests the assessment fee be
reduced to what should be the applicable fee, noting the non-compliances directly relate to design and siting
matters.
The application will not meet statutory timeframes due to the delays caused internally. The lesser RAB fee
is considered insufficient, and the RAP fee is more appropriate without the multiplier applied, making the
fee $2355 less $971 already paid = $1384.

                       Approvals to unit 1)

An application has been lodged for a Minor Change to an Aged Care Facility. The change involves the
addition of a carport to a single unit within a multiple dwelling development. The applicant states that the
proposed building work is for a non-habitable, single storey, unenclosed carport and should be considered
a minor extension.
Previous changes in this complex have been assessed as GIA’s, due to their minor nature, but this carport
is proposed within the setback area and over a sewer easement and can therefore not be assessed as a
GIA. The applicant demonstrates that there is another structure built over the sewer easement within the
site.
