• The property is within walking distance of significant public open spaces, such as:
• Little Cove Beach
• Noosa National Park
• These nearby amenities provide ample opportunities for outdoor recreation and
contribute to overall residential amenity.
• The original assessment of the multiple dwelling under the 1973 Planning Scheme did not
include provisions for private open space.
• As such, there was no formal requirement for private open space design at the time
of approval.
• Consideration of both the current and historical planning schemes suggests that the
issue is largely interpretive and should be viewed in context of the existing built form
and available communal/public open space.
In conclusion, the proposed modifications to Unit 5’s patio area are consistent with the intent and
requirements of Performance Outcome PO12 for private open space and do not compromise the
amenity, privacy, or functionality of the dwelling or surrounding units.
Therefore, the proposed development complies with the Performance Outcome PO12 of the
Medium Density Residential Zone Code.
