Private Open Space
Acceptable Outcome AO12.1 of the Dual Occupancy and Multiple Dwelling Code states:
AO12.1 Private open space is provided for each dwelling at the following rate:
p. at ground level a minimum of 25m² directly accessed from living spaces and exclusive
of clothes drying area; or
q. if above ground level 12m² with a minimum width of 2.5 metres accessed directly from
the living spaces.
The applicant is retrospectively proposing to remove the above ground private open space from
Unit 5 and as such does not comply with AO12.1 of the Dual Occupancy and Multiple Dwelling
Code. The proposal is therefore required to comply with corresponding Performance Outcome
PO12 of the Dual Occupancy and Multiple Dwelling Code, which states:
PO12 Private open space
a. is provided to all dwellings and is adequate in size, shape and dimensions to suit the
needs of the occupants;
b. receives adequate sunlight; and
c. is designed and orientated to ensure privacy is maintained between uses.
Assessment:
The proposed retrospective enclosure of the patio area for Unit 5 complies with the relevant
benchmarks for private open space as outlined in the Noosa Plan 2020, as follows:
• The proposed enclosure retains the area for a convertible space, ensuring it
remains adequate in size, shape, and dimensions to suit the needs of the occupants of
Unit 5 should they wish to use the space for private open space or dining areas
employing the use of convertible bifold windows;
• The use of fully retractable aluminium bifold windows allows the space to function as both
an enclosed and open-air space, maintaining access to sunlight and natural
ventilation from the unit’s northeastern aspect;
• The design retains the existing glazed balustrade and incorporates materials and
orientation that ensure visual and acoustic privacy for both Unit 5 and neighbouring units.
Additional Considerations
• The overall subject site includes existing communal open space areas including a
swimming pool located within the rear of the site, which is accessible to all residents,
including those in Unit 5, refer Figure 6 below.
