following are sufficient grounds to justify the decision despite the conflict:
1. The telecommunications facility will provide coverage for the NBN fixed wireless
network, allowing for the delivery of higher speed data to rural residential households in
the Cooran area; and
2. The proposal will not significantly impact on the visual or residential amenity of the
locality as it is to be located near existing infrastructure, and is screened by existing
vegetation.

MCU15/0034 Aurecon Group for NBN Co 2 L12 on RP883248 ADVICE AGENCY’S RESPONSE Sections 291 and 292 of the Sustainable Planning Act 2009 RESPONSE TO DEVELOPMENT APPLICATION Powerlink Queensland, acting as an advice agency under the Sustainable Planning Act 2009 provides its response to the above application. The advice agency's response is that: XK this application should be approved subject to the following conditions: 1. Compliance with the terms and conditions of easement dealing no. 601108825. 2. Any variation to the proposed layout as shown on the enclosed copy of the submitted Drawing “Overall Site Plan” 4GYM-51-32-SCHR-C2 Rev 02 dated 23/04/2015 shall require resubmission. 3. This advice is valid for a period of 2 years from the date of this response, should the development not be initiated within that period, the applicant should resubmit the application for re-consideration. 4. This response does not constitute an approval to commence any works within the transmission line corridor. While Powerlink Queensland has no ‘in principle’ objection to the proposed MCU, any works on easement would require detailed final design submissions, assessments and approvals (or otherwise) by Powerlink Queensland. We would prefer this information to be submitted in electronic format 3D DXF of final design RL's AHD and MGA GDA94 in applicable zone. In addition, the following requirements should be considered in your Operational Works application for proposed on-easement work. 5. Compliance with the generic requirements in respect to proposed works in the vicinity of Powerlink Queensland infrastructure as detailed in the enclosed Annexure =A", 8. Compliance with the Electrical Safety Act 2002 (‘the Act’) including any Code of Practice under the Act and the Electrical Safety Regulation 2013 (“the Regulation’) including any safety exclusion zones defined In the Regulation. In respect to this application the exclusion zone for untrained persons and for operating plant operated by untrained persons is six (6) metres from the 275,000- volt wires and exposed electrical parts. Should any doubt exist in maintaining the prescribed clearance to the conductors and electrical infrastructure, then the applicant is obliged under the Act to seek advice from Powerlink Queensland. MCU15/0034 Aurecon Group for NBN Co 3 L12 on RP883248 7. In order for Powerlink Queensland to maintain and operate a safe and reliable supply of electricity, we require unrestricted 24-hour access to our infrastructure. Typically such access must be suitable for a 4WD vehicle but to a standard no less than existing, and the need for access by a 100-tonne crane must also be considered. If it is envisaged that there will be any interference to our current access arrangements; we require that the applicant contacts our Maintenance Service Provider: Richard Beames ph (07) 3860 2111 to formalise unrestricted 24-hour access arrangements for Powerlink Queensland. MCU15/0034 ATTACHMENT 1 Total of 3 Pages ANNEXURE A — GENERIC REQUIREMENTS The conditions contained in this Annexure have been compiled to assist persons (the applicant) intending to undertake work within the vicinity of high-voltage electrical installations and infrastructure owned or operated by Powerlink. The conditions are supplementary to the provisions of the Electrical Safety Act 2013, Electrical Safety Regulations 2013 and the Terms and Conditions of Registered Easements and other forms of Occupational Agreements hereinafter collectively referred to as the “Easement”. Where any inconsistency exists between this Annexure and the Easement, the Easement shall take precedence. 1. POWERLINK INFRASTRUCTURE You may not do any act or thing which jeopardises the foundations, ground anchorages, supports, towers or poles, including (without limitation) inundate or place, excavate or remove any soil, sand or gravel within a distance of twenty (20) metres surrounding the base of any tower, pole, foundation, ground anchorage or support. 2. STRUCTURES No structures should be placed within twenty (20) metres of any part of a tower or structure foundation or within 5m of the conductor shadow area. Any structures on the easement require prior written consent from Powerlink. 3. EXCLUSION ZONES Exclusion zones for operating plant are defined in Schedule 2 of the Electrical Safety Regulation 2013 for Untrained Persons. All Powerlink infrastructure should be regarded as “electrically live” and therefore potentially dangerous at all times. In particular your attention is drawn to Schedule 2 of the Electrical Safety Regulation 2013 which defines exclusion zones for untrained persons in charge of operating plant or equipment in the vicinity of electrical facilities. If any doubt exists in meeting the prescribed clearance distances from the conductors, the applicant is obliged under this Act to seek advice from Powerlink. 4. ACCESS AND EGRESS Powerlink shall at all times retain the right to unobstructed access to and egress from its infrastructure. Typically, access shall be by 4WD vehicle. 5. APPROVALS (ADDITIONAL) Powerlink’s consent to the proposal does not relieve the applicant from obtaining statutory, landowner or shire/local authority approvals. 6. MACHINERY All mechanical equipment proposed for use within the easement must not infringe the exclusion zones prescribed in Schedule 2 of the Electrical Safety Regulation 2013. All operators of machinery, plant or equipment within the easement must be made aware of the presence of live high-voltage overhead wires. It is recommended that all persons entering the Easement be advised of the presence of the conductors as part of on site workplace safety inductions. The use of warning signs is also recommended. Page 9 of 15
Page 10
MCU15/0034 ATTACHMENT 1 Total of 3 Pages 7. EASEMENTS All terms and conditions of the easement are to be observed. Note that the easement takes precedence over all subsequent registered easement documents. Copies of the easement together with the plan of the Easement can be purchased from the Department of Environment & Resource Management. 8. EXPENDITURE AND COST RECOVERY Should Powerlink incur costs as a result of the applicant's proposal, all costs shall be recovered from the applicant. Where Powerlink expects such costs to be in excess of $10 000.00, advanced payments may be requested. 9. EXPLOSIVES Blasting within the vicinity (500 metres) of Powerlink infrastructure must comply with AS 2187. Proposed blasting within 100 metres of Powerlink infrastructure must be referred to Powerlink for a detailed assessment. 10, BURNING OFF OR THE LIGHTING OF FIRES We strongly recommend that fires not be lit or permitted to burn within the transmission line corridor and in the vicinity of any electrical infrastructure placed on the land. Due to safety risks Powerlink’s written approval should be sort. 11, GROUND LEVEL VARIATIONS Overhead Conductors Changes in ground level must not reduce statutory ground to conductor clearance distances as prescribed by the Electrical Safety Act 2013 and the Electrical Safety Regulations 2013. Underground Cables Any change to the ground level above installed underground cable is not permitted without express written agreement of Powerlink. 12. VEGETATION Vegetation planted within an easement must not exceed 3.5 metres in height when fully matured. Powerlink reserves the right to remove vegetation to ensure the safe operation of the transmission line and, where necessary, to maintain access to infrastructure. 13. INDEMNITY Any use of the Easement by the applicant in a way which is not permitted under the easement and which is not strictly in accordance with Powerlink's prior written approval is an unauthorised use. Powerlink is not liable for personal injury or death or for property loss or damage resulting from unauthorized use. If other parties make damage claims against Powerlink as a result of unauthorized use then Powerlink reserves the right to recover those damages from the applicant. Page 10 of 15
Page 11
MCU15/0034 ATTACHMENT 1 Total of 3 Pages 14. INTERFERENCE The applicant's attention is drawn to s.230 of the Electricity Act 1994 (the “Act’), which provides that a person must not wilfully, and unlawfully interfere with an electricity entity's works. “Works” are defined in s.12 (1) of the Act. The maximum penalty for breach of s.230 of the Act is a fine equal to 40 penalty units or up to 6 months imprisonment. 15. REMEDIAL ACTION Should remedial action be necessary by Powerlink as a result of the proposal, the applicant will be liable for all costs incurred. 16. OWNERS USE OF LAND The owner may use the easement land for any lawful purpose consistent with the terms of the registered easement; the conditions contained herein, the Electrical Safety Act 2013 and the Electrical Safety Regulations 2013. 17. ELECTRIC AND MAGNETIC FIELDS Electric and Magnetic Fields (EMF) occur everywhere electricity is used (e.g. in homes and offices) as well as where electricity is transported (electricity networks). Powerlink recognises that there is community interest about Electric and Magnetic Fields. We rely on expert advice on this matter from recognised health authorities in Australia and around the world. In Australia, the Federal Government agency charged with responsibility for regulation of EMFs is the Australian Radiation Protection and Nuclear Safety Agency (ARPANSA). ARPANSA's Fact Sheet — Magnetic and Electric Fields from Power Lines, concludes: “On balance, the scientific evidence does not indicate that exposure to 50Hz EMF's found around the home, the office or near powerlines is a hazard to human health.” Whilst there is no scientifically proven causal link between EMF and human health, Powerlink nevertheless follows an approach of “prudent avoidance” in the design and siting of new powerlines. This includes seeking to locate new powerline easements away from houses, schools and other buildings, where it is practical to do so and the added cost is modest. The level of EMF decreases rapidly with distance from the source. EMF readings at the edge of a typical Powerlink easement are generally similar to those encountered by people in their daily activities at home or at work. And in the case of most Powerlink lines, at about 100 metres from the line, the EMF level is so small that it cannot be measured. Powerlink is a member of the ENA’s EMF Committee that monitors and compiles up-to-date information about EMF on behaff of all electricity network businesses in Australia. This includes subscribing to an international monitoring service that keeps the industry informed about any new developments regarding EMF such as new research studies, literature and research reviews, publications, and conferences. We encourage community members with an interest in EMF to visit ARPANSA’s website: www.arpansa.gov.au Information on EMF is also available on the ENA's website: www.ena.asn.au Page 11 of 14 Management of Easement Co-use Requests Guideline Updated 15 May 2014 Version 6.1 Page 11 of 15

LANDSCAPE SPECIFICATION NOTES: EARTH WORKS CLEARING: Clear areas indicated on the drawings of trees, stumps, shrubs, slab foundations, paving and other surface debris. EXCAVATION: Excavate or fill areas to dimensions as shown on the drawings. All debris and material not suitable for backfill shall be removed from the site. Ensure caution when excavating near services. Consolidate areas of fill. TREE PROTECTION: Refer LP2.01 for Tree Retention Plan. All Existing Trees shown on the drawings & located within 50m distance of the NBN compound are to be retained as follows; MARKING: Mark all trees to be retained with a zincanneal tag, painted yellow. Secure the tag to the tree with a loose galvanised steel wire band. At the end of the Contract, the Superintendent will check and remove the tags. TREE PROTECTION ZONES: Trees to be retained are to be protected within tree protection zones (TPZs) as follows - - The perimeter of TPZs must be outside the existing canopy of the vegetation or as specified by the Arboricultural Consultant. - All TPZs are to be fenced with Temporary Fencing Panels (TFP) or Arboricultural Consultant approved alternative. - No person, vehicles or machinery are to enter the TPZs except with the written consent of Council - Any underground service installations must be bored and utility authorities must utilise a common trench where possible. -No fuel, oil dumps or chemicals are allowed to be used or stored within TPZs and the servicing and re-fueling of equipment and vehicles must be carried out away from the root zones. - No storage of material, equipment or temporary building is to take place within the TPZs. - Nothing whatsoever is to be attached to any tree including temporary services wires, nails, screws or any other fixing device. -TPZ fencing is not to be relocated without specific approval from the Consulting Arboriculturist and the Ecologist or Landscape Architect. EXCAVATION: Do not remove topsoil from within the drip line of trees to be retained unless otherwise specified. If it is necessary to excavate within the drip line, use hand methods such that root systems are preserved intact and undamaged. Open up excavations under tree canopies for as short a period as possible. Do not place spoil from excavations against tree trunks, even for short periods. All care shall be taken to avoid damage to the bark of trees. TREE ROOT TREATMENT: Do not cut tree roots exceeding 50 mm diameter unless permitted by the Superintendent. Where it is necessary to cut tree roots, use a chain saw or similar means such that the setting does not unduly disturb or rock the remaining root system. Immediately after cutting, apply an approved fungicidal sealant to the cut surface. BACKFILL to excavation around tree roots with an imported topsoil mixture as specified. Add fertilizer at the rate of 0.5kg/m3 as specified in PLANTING. Place the backfill in layers, each of 150 mm maximum depth, solidly compacted to eliminate voids. Do not backfill around tree trunk to a height greater than 150 mm above the original ground surface. WATERING: Immediately after backfilling, thoroughly water the root zone surrounding the tree. DECOMPACTION: If the ground under the tree canopies has been unduly compacted during the work under the Contract, for example by the operations of heavy constructional plant, loosen the soil to a depth of 150 mm. STOCKPILES: Do not stockpile materials near trees to be retained. RETAINED TREES are to be assessed by a qualified arborist to identify necessary pruning and tree surgery works. Where pruning of retained trees iS required it is to be undertaken in accordance with AS4373/96 and the "three-cut' method is to be utilised. DAMAGE TO EXISTING TREES: Should any tree be damaged during the work under the Contract, and if the Superintendent permits repair work to be done, such repair work should be performed by an approved tree surgeon at no extra cost. REMOVAL: If repair work is considered impracticable, or is attempted and fails, if so directed, remove the tree and root system, make good as necessary, and either replace the tree or pay damages, as determined by the Superintendent. REPLACEMENT: Provide, plant and establish as part of the works, at no extra cost to the Principal, a replacement tree of the same species and similar size or as approved by the Superintendent. DAMAGE ASSESSMENT: If replacement as part of the works is not approved, pay for any tree removed pursuant to the above, damages assessed by the Superintendent as the cost of replacement by others or to a maximum cost of $3,000 unless otherwise specified. CULTIVATION Cultivate all new planting areas to a minimum depth of 200mm. TOPSOIL & MULCHING TOPSOILING TYPE : Imported topsoil from an approved supplier to AS 4419 2003. Ensure soil is free of stones, weeds, sticks, roots and other deleterious material toxic to plant growth. DEPTH Planting Areas: 150mm SPREADING: Spread topsoil to the depths indicated and lightly compact so that the surface is smooth, free from hollows and has even grade falls. Spread the soil flush with any abutting surfaces generally, but allow for the depth of mulch as necessary. MULCHING Place a mulch ring to each plant at time of planting. TYPE: 25mm Forest Litter mulch to a depth of 75mm to all plants indicated on the drawings. The mulch must be free from soil, weed growth and other deleterious material harmful to the plants and finished 25mm below the final surface levels of adjacent surfaces. PLANTING PLANT MATERIAL: Only use vigorous, well established plants of local provenance with large healthy root systems that show no evidence of having been restricted or damaged. Plants must be free from any pests and disease, well hardened off and of a good form consistent with their species or variety. PLANT SIZES: Where a minimum plant height is specified in the "PLANT SCHEDULE" the height shall be the vertical distance between the top of the pot and the natural top of the plant whilst standing vertically in the pot. SUBSTITUTIONS: Make no substitutions unless provided in writing. Substitutions will not be approved if plants have not been made available for inspection at the Nursery within 30 days of the Contract being awarded. REPLACEMENTS: Replace, with plants of the same specified type, quality and size, any plants which fail or are damaged during the work under the Contract. WARRANTY: Furnish a warranty from the supplier attesting that the plants are true to the specified species and type, and free from diseases, pests, weeds and the like. STORAGE: Wherever possible, plants shall be planted immediately after delivery to the site. If this is not possible, keep them in good condition by appropriate storage methods, or as may be directed. Prevent theft, drying out or damage from any cause including frost, wind, sun, vermin, animals and the like. Provide an on_site nursery for holding plant stock on site for more than 48 hours, of sufficient size, with provision for watering. POTTING ON: If directed, pot plants into larger soil-filled containers to prevent them becoming root bound if there is an unforeseen delay. The Contractor shall bear the cost of potting on. Do not carry out potting on unless authorised. POT SIZES: Supply plants in weed-free containers of the sizes specified in the "PLANT SCHEDULE" shown on the drawings. PLANT TYPES: Refer Plant Schedule PLANTING: Water the plant and the planting areas thoroughly before planting begins. The planting holes should be large enough to allow the placement of the plant without damaging its root system. Remove plants carefully from container ensuring minimum soil loss and root disturbance. Root prune any root bound plants. Place plants centrally in their holes and so that the top of the soil level in the pot is 20mm below the finished surrounding soil level. Fertilize with a slow release tablet form of fertilizer. Backfill all holes using imported topsoil as specified. Water plants thoroughly. Tree Planting & Staking: Refer DETAIL LDO1. SPADE EDGING: To each plant shown on the landscape plan provide a spade cut edge as per detail LD02. STOCK PROOF FENCING: in the locations shown on the drawing, install stock proof fencing to DETAIL LDO3. Provide Timber Edging to the base of fence and an 800mm wide gate for Maintenance Access. ESTABLISHMENT & MAINTENANCE General Landscaped areas shall be maintained by the Contractor from the time of installation until the end of the Landscape Establishment Period. The Landscape Establishment Period shall be 12 months, with two (2) weekly visits for the first three (3) months, then monthly for remaining of nine (9) month period. Maintenance shall include watering, fertilizing, mowing, weeding, pruning, pest and disease management, plant replacement, site drainage and general tidying of the treated areas. WATERING watering shall be carried out at sufficient frequency to ensure establishment of the plants and to achieve the specified acceptance criteria. notwithstanding this requirement, watering shall be carried out at the minimum frequency stated in table 1 below. the stated rate of watering shall include any rainfall. One watering shall be defined as the application of - (a) for hydraulic seeding and mulching and grass seeding, 5l/m2 of water in not less than one hour; (b) for turfing, 101/m2 of water in not less than one hour; (c) for planting, in accordance with table 2. Watering of seeded and turfed areas shall be applied using a fine spray. Watering of such areas in weeks 8 and 12 shall occur immediately after fertilizing. Watering of plants shall be directed at the base of the plant to thoroughly water the root ball. Watering shall not cause erosion or displacement of treated areas. No water shall be allowed to spray onto, flow across or pond on paved areas including roadways, bikeways and footpaths. Pruning Plants shall be pruned as necessary to promote vigorous new growth. Pest and Disease Management Plants shall be monitored for pest and disease incidence on a weekly basis. Acceptable plant protection techniques shall be employed to manage any infestations. Site Drainage All landscape areas shall be maintained with sound drainage principles and the avoidance of runoff from the Site shall be enforced. Each irrigation of the Site shall be over a period of time that allows water infiltration (percolation) via the soil and does not produce run-off water. Tidying All landscaped areas shall be kept in a neat and tidy condition during the Landscape Establishment Period. Tidying shall include but not be limited to: the collection and removal of litter, plant prunings and dead plants; removal of mulch from roads and pathways; checking and adjusting plant support stakes and ties; and making good any disturbance to the surface of mulches. Plant Replacement Replace at no extra cost, any plant which dies from the cause whatsoever during the Establishment period. Plant replacements shall be of the same size and species and equal to size and similar plants at the time of death. 75mm min. mulch over edge. W Seeding or turfing as per approved Landscape Plan.
