3.1 PRELODGEMENT MEETING
On 8 September 2022, a prelodgement meeting was undertaken with Council officers. The original
proposal involved a mixed-use development involving a proposal for 5 short term accommodation units
and 1 food and drink outlet on the ground floor. The proposal included a larger commercial tenancy
and only included 5 onsite carparking spaces, compared to the current proposal.
Council prelodgement notes indicated that any application would be code assessable, with a
recommendation to be made by Council officers and decision to be determined by Council.
Council’s prelodgement notes recommended compliance was required against the following matters:
▪ Building height – 12m or 3 storeys
▪ Site cover – 45% where a mixed-use development
▪ Plot ratio – 0.8:1 permitted
▪ Setbacks – proposal complies except for rear setback of the 3rd storey
▪ Privacy – overlooking needs to be mitigated
▪ Hours of Operation – are consistent with the code
▪ Carparking – a contribution in lieu of car parking needed to offset the short fall in required car
parking numbers.
▪ Building design – recommended to suit the subtropical climate and incorporates a mix of
lightweight and textured materials (including timber finishes with variation in texture, detailing
and articulation)
▪ Carparking – Car park needs to be functional to facilitate vehicles entering and exiting in a
forward direction.
▪ Stormwater – must be directed to Council’s stormwater system without impacting adjoining
premises.
▪ Landslide – the development will need to include a site-specific geotechnical report addressing
the stability of the site.
▪ Contributions in lieu of parking – improved compliance would facilitate the use of the policy.
The applicant has taken this feedback into consideration as part of the revised proposal.
Discussions with Council’s executive management (i.e. CEO) have lead to further refinements to the
design to ensure that the proposal is as compliant as possible with the planning scheme’s
requirements. However, it is noted that strict compliance with all the relevant assessment
benchmarks is not practical or economically feasible due to the site’s constrained area and sloping
land and taking into account the overall outcomes of the Tourist Accommodation Zone code.
Following these design amendments, a briefing of the proposal was presented to the local Councillors
for their consideration and review.
