Business Uses Code
Noise
The applicant submitted an acoustic impact assessment to address the requirements of the
Environmental Protection (Noise) Policy 2008. The primary noise sources associated with the
development use will be:
Continuous steady noise from mechanical plant and equipment such as air conditioning
and refrigeration equipment
Intermittent transient time varying noise from truck load out and delivery and waste
collection, car doors, patron noise.
Intermittent transient noise from trucks and fleet traversing local roads and trafficable
areas.
Amplified Music and Entertainment Noise from the use of the tavern.
The acoustic impact assessment has utilised assessment methodology in accordance with the
DEHP Guideline: Planning for Noise Control. The acoustic impact assessment was assessed
against the relevant criteria in the Environmental Protection (Noise) Policy 2008, the relevant
sleep disturbance criteria, and the Office of Liquor & Gaming Regulation (OLGR) noise criteria.
The outcome of the assessment has established compliance with the specified limits, with the
exception of some noise types at specific times of the evening and night time periods. The noise
control measures outlined in the noise impact assessment report can be applied to control noise
emissions in order to meet the relevant criteria and would ensure acceptable levels of amenity for
residents in the area. In particular, the tavern building is identified for significant acoustic
upgrades as part of the refurbishment. Upgraded insulation to the façade, glazing and roof will
significantly improve the buildings acoustic attenuation.
Noise from amplified music and entertainment in the outdoor beer garden area will result in levels
at 8 dB (C) above existing ambient background levels based on the application of the OLGR
criteria. This may result in nuisance complaints where extended hours of operation of the tavern
are approved and the use of this area is for amplified entertainment. A condition would need to
be applied to restrict the use of this area to daytime and evening periods only, with it to be closed
after 10pm.
Outdoor Dining
The active frontages proposed to Pinaroo Way will abut the road boundary and provide
opportunities for outdoor dining. Further details of possible locations and shade structures
should be considered at operational works assessment stage.
