PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 11 JUNE 2019

2.   1675 Louis Bazzo Drive, Boreen Point, 3RP186809 (51.5ha)
Being newly purchased land, Council has not had an opportunity to consider whether
3RP186809 is a ‘buy and hold’ or ‘buy and sell’ proposition with Nature Refuge protection. There
may be several options available, such as;
 On-selling the entire parcel with Nature Refuge over most of it.
 Subdivision for park purposes and on-sell the low biodiversity parcel.
The advantages and disadvantages of various options would be explored in a business case.

4. State Government advice on subdivision exemptions for park purposes
Council sought advice from the State Government about subdivision exemptions under the SEQ
Regional Plan for the purposes of establishing a park. The State advises that a park subdivision
would be considered exempt subdivision where only 1 new lot is created for that park purpose. If
the lot is within the regional landscape and rural production area (RLRPA) of Shaping SEQ
Regional Plan, the balance lot must remain in the RLRPA.

Park is defined in the Planning Regulation 2017 – means the use of premises, accessible to the
public free of change, for sport, recreation and leisure activities and facilities.

Therefore as long as the proposed park lot remains accessible to the public free of change and is
for the types of activities mentioned in the definition the exempt subdivision would apply.
