PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 11 JUNE 2019
3. ASSESSMENT
3.1. Instruments for Statutory Assessment
Under the Planning Act 2016 the application must be assessed against each of the following
statutory planning instruments to the extent they are relevant to the development:
State Planning Policy;
South East Queensland Regional Plan;
Planning Regulation 2017;
Noosa Plan 2006; and
The Draft New Noosa Plan (to the extent weight should be given to this document with
public notification recently completed).
3.2. State and Other Statutory Instruments
State Planning Policy
The State Planning Policy 2017 (SPP) predates the Noosa Plan 2006, and therefore is to be
considered in the assessment. With respect to the SPP, the assessment of the application does
not raise any matters that require assessment.
South East Queensland (SEQ) Regional Plan
The site is located within the Urban Footprint area of the SEQ Regional Plan. The proposal is for
an urban purpose and is consistent with the regional policies of the SEQ Regional Plan.
Planning Regulation 2017
The proposal is for urban activity within the Urban Footprint and is consistent with the
assessment benchmarks contained in the Planning Regulation 2017 for the SEQ Region.
3.3. Statutory Instruments – Planning Scheme
The application is subject to impact assessment and therefore is to be assessed against the
whole of the planning scheme. The application is to be assessed against the following codes to
the extent relevant for the proposed Industrial Business Type 2 Production, Alteration,
Repackaging, & Repairing (Brewery) and Entertainment & Dining Type 3 – Bar (Brew Café):
- Noosaville Locality Code;
- Business Uses Code;
- Landscaping Code; and
- Engineering Works Codes
Noosaville Locality Provisions
The subject land is located in the Noosaville Locality and is included in the Industry zone. The
proposed Industrial Business Type 2 (Brewery) use is consistent within the Industry zone and
would ordinarily be subject to code assessment because the proposal involves new building work
and there is an increase in use area. The Entertainment and Dining Type 3 – Bar (Brew Café)
use is not consistent within the Industry zone and is therefore subject to impact assessment.
Other approvals for similar developments have been approved for breweries within the Industry
zone, with food and beverage being ancillary and complementary to the primary industrial use
(refer MCU16/0112 – Heads of Noosa & MCU16/0133 - Land & Sea). These uses were approved
on the basis that the scale of food and drink are to remain ancillary to the predominate industrial
use, and associated car parking requirements were able to be provided for on site. Further, these
developments would not cause any significant amenity or traffic impacts being located within the
industrial estate.
