5. CONCLUSION & REASONS FOR DECISION
The applicant seeks a development permit on land at 27 Attunga Heights, Noosa Heads for:
Material Change of Use (2 Detached Dwellings and 12 Multiple Housing Units); and
Reconfiguration of a Lot (1 into 4 lots plus Access Easement).
The applicant has provided extensive grounds and numerous supporting specialist reports
recommending the favourable assessment of the proposed development, which largely pertain to
the location of the proposed development footprint being a far better outcome than otherwise
developing the existing Detached Housing and Attached Housing zoned land.
The proposed development is however assessed as largely not complying with key Noosa Plan
provisions relating to density, height, gross floor area and setbacks. Furthermore, the proposal
extends substantially outside the developable areas identified by The Noosa Plan zone map, and
into large parts of the site designated Open Space Conservation.
It is recognised that the most developable area of the site extends off Attunga Heights, which
includes the existing dwelling, more moderate slopes and vegetation of lessor value being weed
infested. The proposed development however significantly extends outside the potential
development area and is not of a scale and density consistent with existing and permitted
development in the Attunga Heights.
The proposed development also fails to adequately protect the environmental values and
respond to the natural hazards of the site and adjoining land, given the substantial clearing and
or modification of mapped protected areas and earthworks likely to be required, both for
construction purposes and the finished product.
