PROJECT URBAN – 21172 25 Feb 2022
7.5 ZONE CODE
An assessment of the Medium Density Residential Zone code has been included within
Attachment 1. The assessment has determined that the proposed development complies with all
relevant performance outcomes. Where acceptable outcomes are not met, compliance with the
corresponding performance outcome is provided below.
7.5.1 ALTERNATIVE SOLUTIONS
AO12.1 Buildings and structures meet the following minimum boundary setbacks:
(a) for frontages — 6 metres
(b) for side boundaries—
i. 1.5 metres setback up to 4.5 metres height;
ii. 2 metres setback between 4.5 metres and 7.5 metres height; and
iii. 2.5 metres where above 7.5 metres height for the rear boundary - 6 metres
The proposal largely complies with setbacks. Front setbacks comply with the exception of a small
section of balcony and roof towards the northern boundary of the Clipper Street frontage. This
area comprises 1.8m2 and is highlighted on the Site Plan. Side setbacks comply with the
exception of a small section of balcony and roof to the southern boundary. This area comprises
1.9m2 and is highlighted on the Site Plan.
These setback intrusions are minor and will not result in any detrimental amenity impacts to users
pf the site or adjoining premises; will not unreasonably obstruct views or cause overlooking;
provide adequate distance from adjoining uses; allow space for landscaping; and remain
consistent with surrounding character in compliance with performance outcome PO12.
AO14.1 Development provides visual interest to the street and surrounding areas through:
(a) highlighting individual dwellings and land uses;
(b) an asymmetrical design presentation to the street;
(c) offsetting or staggering dwellings to provide variation in the frontage;
(d) varying the roof form
While the proposal provides visual interest to Clipper Street, the design approach does not
incorporate all aspects of AO14.1. The design presents more as a single dwelling to the street.
While the unit divisions are evident to the upper balcony level, the ground level garages are
screened so they do not dominate the street or design.
The design provides for a positive contribution to the streetscape; has balconies and built form
that address and enhances the street; has a form and architectural scale that does not dominate
the streetscape or the surrounding properties; does not detract from the visual amenity of
adjoining properties through the impact on views, access to sunlight or overlooking; as small
dwelling units enables the building mass to present as a dwelling house in form; and sits in a
landscaped setting; in compliance with performance outcome PO14.
