7.0 THE NOOSA PLAN

Under the Noosa Plan the site is located in the Noosa Heads Locality and partly within the Community
Services Zone (Lot 3) and partly within the Business Centre Zone (Lots 2 and 94), as shown in the zone
map extract below.

7.1    LAND USE DEFINITION

The proposed development is defined under the Noosa Plan as:

         Entertainment and dining business means the conduct of a business activity, where
         entertainment, amusement, recreation or meals are afforded. The term includes the following
         types:
             Type 3 Bar The use of premises for the serving of liquor for consumption on the premises
             for which a general or cabaret license is required under the Liquor Act. The use may
             include amplified music, live entertainment and a dance floor. The use includes a hotel or
             nightclub but does not include a restaurant.

         Retail business means the conduct of a business activity, where goods or services are displayed
         or offered for sale to the public. The term includes the following types:
             Type 2 Shop & salon - The use of premises for an activity that is generally found in a
             shopping complex, strip or centre. The use includes a shop, hairdressing salon, appliance
             repairs, alterations, dry cleaning and a café with dining facilities for up to 10 people.

         Commercial business means the conduct of a business activity, where a service is offered or
         provided and that service is not more clearly defined by other business or community uses. The
         term includes the following types:
             Type 1 Office The use of premises for a commercial business conducted in an office
             environment. The use includes a bank, professional office, travel agent, and estate sales
             office.

         Education means any use conducted predominantly for the purpose of education, instruction,
         information sharing and learning. The term includes the following types:
