PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 12 JULY 2022

undertaken by Council’s contractor via rear lift trucks with the trucks collecting 1100
             litre bins.
     43. The developer must provide waste storage and disposal facilities in accordance with
Planning Scheme Policy 9 - Waste Management. The facilities must include an
impervious area, within the site, correctly sized for all refuse and recycling containers
and suitably screened from public places and neighbouring properties. A bin wash area
is required with a cold-water tap, hose and drain outlet connected to sewer, via a bucket
trap. The drain outlet must be designed to prevent storm water entry to the sewerage
             system.
     44. Refuse containers must be provided in accordance with the requirements of the
Environmental Protection (Interim Waste) Regulation 1996 and (Waste Management)
Regulation 2000, for the storage and collection of refuse.
     45. Storage, disposal and management of solid, liquid and vegetative waste is conducted
in a safe and ecologically sustainable manner without environmental nuisance. In this
regard, vegetated waste must be disposed of via a green waste bin or at a local transfer
             station.
B. Note the report is provided in accordance with Section 63(5) of the Planning Act 2016.

REPORT
A report for this application was presented to Council at the Planning and Environment Committee
on 12 April 2022. The report recommended that the application be refused based on the proposal
not complying with site cover, plot ratio, setbacks and landscaping and the development not being
consistent with the streetscape or the surrounding area.
On 19 April 2022 the applicant stopped the Decision-Making Period until 22 April 2022 and
subsequently extended the Decision-Making Period until 21 July 2022 to allow for an amended
proposal to be considered by Council.
On 26 May 2022 Council officers met with the applicant at which time some agreement was
reached in terms of design changes that would address Council’s concerns. It was generally
agreed to:
• Increase the setback to the front road boundary from the outermost projection of the building
so that it is no less than 5m from the boundary. It was noted that the increased setback could
be increased by a combination of things including:
o a relaxation to the rear setback. Pushing the whole development towards the rear
           boundary by 0.5m;
o push units 6 & 7 back towards the rear boundary instead of forward by approximately
           0.9m, still retaining the articulation in the back wall of the building;
o reduce the depth of the overhang on the front of units 1-4 if necessary to achieve a 5m
           minimum setback.
• Create small units to increase the small unit numbers and allow the bonus provisions for site
cover and plot ratio to apply being up to 45% for site cover and 0.5:1 for plot ratio.
• Provide additional landscape treatment in the rear of the courtyards of Units 1-5 to offset the
decrease in size. This may involve retaining walls to make the area more useable, with soft
     landscaping along the back.
• Increase the landscaping in the front of units 1-4 and remove the lightweight screens unless
they can be pushed back behind the setback area.
The applicant submitted revised plans on 8 June 2022 and it is these plans that form the basis of
the assessment.
