PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 12 JULY 2022

Figure 7: Original proposal: Side Elevation and illustrating front setback

Side Setback
The eaves to the ground and upper level of the buildings at the front of the site intrude into the side
setback, 1.1 metre setback to the ground floor in lieu of the required 1.5 metre setback and 1.4
metres to the upper floor in lieu of 2.0 metres. The intrusions of the eaves within the setback are
minor and will not unreasonably affect the amenity of the adjoining properties or the streetscape.
Rear Setback
The original proposal included a rear setback of 2.4 metres to the covered ground level terraces
and a compliant 6.0 metre setback to the rear façade of the buildings. The original report noted:
The proposed 2.4 metre rear setback to the lower level terraces will not be detrimental to the
adjacent properties due to their modest height of approximately 2.7 metres and the capacity
for landscaping to be provided adjacent the common boundary to screen the development.
The rear setbacks now proposed are:
Ground floor level
• 2.5 metres to terraces
• Setback to building ranging from 4.5 metres to 5.5 metres
First floor level
• 1.5 metres to upper level decks of the small dwelling units
• Setback to building ranging from 4.5 metres to 5.5 metres
The setback to the ground floor roofed terraces remains consistent with the originally proposed
setback which was supported in the initial officer report. The proposed setback of the building
ranging from 4.5 to 5.5 metres is generally consistent with the agreement reached in the meeting
with Council officers.
The proposed 1.5 metre setback of the upper level roofed decks (x2) was not discussed in the
meeting with Council officers. Accompanying the introduction of 2 small dwelling units to the upper
level of the rear building is a requirement for these dwelling units to have at least 9m2 of private
open space, and the applicant has elected to position this space as an upper level balcony to the
rear of the building. A 1.5 metre rear setback is a significant variation of the required 6.0 metre
setback.
The survey plan submitted with the application details that the ground level at the boundary
adjacent to where the 2 upper-level roof decks are to be located is 15.86 AHD. The section plans
detail that the floor level of the upper-level deck to units 9 and 10 will be at 17.95 AHD with the
point of the roof closest to the rear boundary at approximately 20.75 AHD. A 1.8-metre-high fence
is proposed atop the retaining wall in this location, with the top of the fence being at approximately
