PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 12 JULY 2022
17.65 AHD. The roof of the 2 upper levels balconies would therefore be 3.1 metres above the top
of a new 1.8-metre-high fence and setback 1.5 metres. The following image details the relationship
between the rear boundary fence and the upper-level decks.
Figure 8: Section plan detailing rear boundary fence and upper-level decks
Whilst a 3.1-metre-high open roofed structure would not present unreasonable bulk to the adjoining
properties the potential amenity impacts associated with the use of this structure require
consideration. In this regard, a site inspection has confirmed that the area on the adjoining
properties adjacent to the proposed decks currently enjoys a high degree of privacy. The applicant
has agreed to a condition being included requiring the upper-level balconies of proposed Units 9
& 10 to have fixed privacy screens on the outside edge to address overlooking. This is considered
a suitable mechanism to address the potential for overlooking.
Landscaping
The small dwelling bonus provisions within the planning scheme reduce the extent of landscaping
required from 40% to 35%, with 60% being soft landscaping. The original proposal was deficient
in landscaped area by 180m2, the amended proposal provides for 33.6% of the site as landscaped
area which is a deficiency of 29m2. The amended proposal exceeds the soft landscaping
requirement by approximately 76m2. The minor variation to the landscaped area will not have a
detrimental impact on the streetscape and surrounding properties noting that meaningful soft
landscaping which exceeds the scheme requirement is provided throughout the site.
Visitor car park
The proposal is lacking a visitor car space. Council’s development engineer has confirmed that
another visitor space could be provided adjacent to either one of the 2 proposed spaces which are
both located centrally within the site and positioned at right angles to the side boundary. An
additional visitor car space would require a minor encroachment into proposed landscaping, this
minor encroachment would not detrimentally compromise the landscaping outcome proposed by
the outcome. It is recommended that a condition be included requiring the provision of an additional
visitor car parking space.
