PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 9 DECEMBER 2014
3. ASSESSMENT
3.1. Instruments for Statutory Assessment
Under the Sustainable Planning Act 2009 the application must be assessed against each of the
following statutory planning instruments to the extent they are relevant to the development:
State Planning Policies;
the South East Queensland Regional Plan;
State Planning Regulatory Provisions;
any Structure Plan or Master Plan in place for declared areas;
any Preliminary Approval Overriding the Planning Scheme for the land;
the Planning Scheme for the local government area; and
any Temporary Local Planning Instrument in place for the local government area.
Of these, the statutory planning instruments relevant to this application are discussed in the
sections that follow.
3.2. State and Other Statutory Instruments
State Planning Policies
The application complies with the interim development assessment requirements of the State
Planning Policy 2014.
South East Queensland (SEQ) Regional Plan 2009 - 2031
The site is located within the Regional Landscape and Rural Production Area area of the SEQ
Regional Plan. The proposal is consistent with the Regional Policies and Regulatory Provisions
of the SEQ Regional Plan.
3.3. Statutory Instruments – Planning Scheme
The subject site is located in the Tewantin & Doonan Locality and is zoned Rural Settlement. The
proposed use is identified as inconsistent use within the zone and is required to follow an impact
assessable application process.
Locality Provisions
The Tewantin & Doonan Locality Code seeks to ensure that new uses are appropriately sited and
maintain the amenity of existing residents. The expanded golf course will abut two new rural
residential properties to the east. A small dwelling on one of the lots is built close to the common
boundary with the development and will be approximately 60m from the nearest new tee-off area
(hole 17) and 30m from the nearest green (hole 16). Some conversational noise is likely to be
heard at the dwelling but this is infrequent and not considered an unacceptable impact. A
condition is recommended requiring screening vegetation along the boundary in this location to
provide some visual privacy and protection from stray golf balls.
Land Use, Works and Overlay Provisions
The following further codes relating to land use, design and overlay constraints are applicable to
this application:
Community Uses Code
Landscaping Code
Engineering Works Code
Biodiversity Overlay Code
The pertinent issues arising out of the assessment against the codes are discussed below:
