PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 9 DECEMBER 2014
B. Find the following are sufficient grounds to justify the decision despite the conflict with the
Planning Scheme:
1. The development provides for a practical infill development to support a growing
urban settlement of permanent residents in Cooroy.
2. The proposal is compatible with the residential zoned land surrounding the site;
3. The proposed residential uses are compatible with the constrained site access
provided via Blue Wren Place, with more intensive development unlikely to be
suitable.
4. The use of the site for residential uses will not unduly impact Cooroy’s ability to
provide for a range of community uses.
REPORT
1. PROPOSAL
The application seeks a Development Permit to Reconfigure a Lot (2 into 25 lots & park) and a
Preliminary Approval for a Material Change of Use application made under Section 242 of the
Sustainable Planning Act to allow future development to be carried out in accordance with the
Detached Housing zone. The site is within the Community Services zone and the development of
detached houses is currently inconsistent within the zone. The application is before Council
because it seeks to override the provisions of The Noosa Plan.
The proposed subdivision design involves the creation of a new cul-de-sac connecting to Blue
Wren Place. The layout takes into account the future development rights and access associated
with the adjoining lot to the north (Lot 3 on RP113733). No access is proposed to Elm Street, due
to traffic concerns relating to the site’s proximity to the intersection of Elm Street and Pearsons
Road.
The proposal includes re-profiling the site to direct some stormwater flows towards the waterway
located to the east, while maintaining flows to the undeveloped site to the north. A bio-retention
basin is proposed within the park adjacent to the waterway. The locality and proposal plans are
included as Figures 1 and 2 below.
