5.     The proposal represents a scale of development, which well exceeds the needs of the
       community and, at a minimum, is excessively premature.
6.     The application relies on inadequate or irrelevant planning grounds to justify its departure
       from the provisions of The Noosa Plan.
The decision was appealed by the applicant (Planning & Environment Court appeal ref. 182/09)
and a number of parties elected to become co-respondents to the appeal defence. The case
proceeded to trial but the appellant subsequently discontinued the appeal in May 2011. Stockwell
sold the site to QIC early in 2012.

Sunshine Coast Council undertook a review of the Noosa Business Centre planning provisions in
2008 and 2009. The Review recommended a number of minor changes to the NBC provisions but
these have generally not been adopted by the new Noosa Council. Review of the Centre was also
undertaken by the Sunshine Coast Council at the time of the draft Sunshine Coast Regional
Planning scheme, with only minor land use amendments drafted. The Noosa portion was removed
from the final version of that planning scheme following de-amalgamation.

Noosa Council has progressed planning scheme revisions (currently on public notification in
September 2015) but these include only very minor amendments to NBC provisions.

Various recent development approvals have been issued on adjacent land to the west of the site
within the NBC. The table below provides summary details, with the location of these shown in
Figure 18.
