PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 11 DECEMBER 2018
Applicant’s response:
The proposed changes will not remove a component that is integral to the operation of the development.
Assessment:
The reduction in the physical industrial business area and the increase in Entertainment and dining
business results in the operation not being ancillary to the Industrial business on site. It is considered to
be operating more akin to an Entertainment and Dining Business Type 3 – Bar. Increasing the scale of
the Entertainment and Dining Business is removing the subordinate component which is integral to the
approved development.
(f) significantly impacts on traffic flow and the transport network, such as increasing traffic to the site;
Applicant’s response:
The proposed changes are predominantly internal and will not significantly impact on traffic flow and the
transport network. Anecdotal evidence of the current operation indicates the business rarely occupies all
parking spaces within the development at a single time. In the rare times where overflow parking is
required, it is noted that the proposed function activities only occur outside normal business areas where
there is sufficient on-street parking available within the industry precinct.
Assessment:
In regard to car parking and traffic, the approval allows for product release events to occur after general
industrial estate business trading hours. The application triggers significantly more car parking spaces
which cannot be provided on site may have traffic related impacts and would require further assessment.
(g) introduces new impacts or increase the severity of known impacts;
Applicant’s response:
The proposed changes reflect existing operational arrangements and will not introduce new impacts or
increase the severity of known impacts.
Assessment:
The proposed new use is likely to increase the severity of impacts such as noise, car parking and traffic.
(h) removes an incentive or offset component that would have balanced a negative impact of the
development;
Applicant’s response:
The proposed changes do not remove an incentive or offset component that would have balanced a
negative impact of the development.
Assessment:
Agree
(i) impacts on infrastructure provisions.
Applicant’s response”
The proposed changes do not impact on infrastructure provisions.
Assessment:
Agree
The proposed change to the development approval to ratify the current operations does not constitute a
minor change as the development results in a substantially different development.
