prescribed in the Environmental Protection Regulation 2008 (EP Reg).
The EP Reg provides details for matters dealt with in the EP Act, including procedures for environmental
impact statements, environmentally relevant activities, and environmental nuisance.
The Environmental Protection (Water) Policy 2009 (EPP Water) ensures protection of environmental values
from activities that may result in the release of contaminants to watercourses or stormwater drains.
The Environmental Protection (Air) Policy 2008 (EPP Air) ensures protection of ambient air quality and
specifies indicators and air quality goals for control of the release of airborne contaminants.
The Environmental Protection (Noise) Policy 2008 (EPP Noise) specifies an acoustic quality objective for the
protection of well-being and amenity of individuals and the community in residential areas. Planning noise
levels are also specified for development of beneficial assets.
The Nature Conservation Act 1992 (NC Act) and subordinate legislation provides a framework for the
conservation of nature, by specifying management principles and intents for areas and species of
conservation significance.
The Vegetation Management Act 1999 (VM Act) and subordinate legislation regulates the clearing of native
vegetation mapped as either remnant vegetation on a regional ecosystem (RE) map or remnant map, or
regulated regrowth vegetation identified on a regrowth vegetation map, as well as native woody vegetation
on State lands.
The Sustainable Planning Act 2009 (SPA), together with the subordinate Sustainable Planning Regulation
2009 (SPR), seeks to achieve ecological sustainability by managing the process by which development
takes place, managing the effects of development on the environment, and continuing the coordination and
integration of planning at the local, regional and State levels.
The Land Protection (Pest and Stock Route Management) Act 2002 governs the management of pest plants
and animals, and the application of controls and restrictions on ‘declared pests’.
The Aboriginal Cultural Heritage Act 2003 defines the duty of care to ensure that all reasonable and practical
measures are taken to prevent damage to places and objects of Aboriginal cultural, historical or
