Construction Environmental Management Plan
The term waters includes river, stream, lake, lagoon, pond, swamp, wetland, unconfined surface water,
unconfined water, natural or artificial watercourse, bed and bank of any waters, dams, non-tidal or tidal
waters (including the sea), stormwater channel, stormwater drain, roadside gutter, stormwater run-off, and
groundwater and any part thereof.
3.3 Program and Contractual Obligations
This CEMP covers the construction works phase of the proposed development. This is defined as the period
from the commencement of works, including any vegetation clearing and earthworks, to the substantial
completion of the development including road-works, building works, stormwater, sewer and drainage, water
and electrical reticulation and landscaping works.
The Contractor is generally responsible for ensuring that the provisions of the CEMP are met, unless
explicitly stated within this CEMP.
No works are to be undertaken unless all necessary permits have been obtained from the relevant
administering authorities. All works are to be undertaken in accordance with the terms and conditions of
these permits.
The Contractor shall ensure that all persons who are to be employed or sub-contracted for the works shall be
adequately trained in respect of their individual responsibilities as set out in this CEMP and as provided by
the Act, including, but not limited to, the following:
General Environmental Duty – whereby a person in the performance of their duties shall not do so in a
manner which will cause, or is likely to cause, environmental harm unless the person takes all
reasonable and practical measures to prevent or minimise the harm;
Duty to Notify Environmental Harm – whereby if a person in the performance of their duties becomes
aware that serious or material environmental harm is caused or threatened then the person must contact
the Contractor whereupon the Contractor must immediately notify the Principal, NSC and/or DEHP; and
Compliance with the CEMP – whereby a person in the performance of their duties shall do so in a
manner that ensures that the provisions of this CEMP are complied with.
3.4 Non-compliance with the CEMP and Corrective Action Requirements
The Contractor shall assume responsibility for implementation of this CEMP. Where the Contractor becomes
aware of a site or operational condition that does not comply with stated performance indicators of this
CEMP, there is a requirement for a corrective action. A Corrective Action Request (CAR) form shall be
completed and authorised where appropriate in general compliance with the example CAR form provided in
Appendix B of this CEMP or similar. The Contractor shall also maintain a register of CARs, which shall
demonstrate that appropriate actions have been completed within a suitable timeframe.
Any CAR registered in accordance with this CEMP shall be provided to the Principal and may be provided to
any Local, State or Commonwealth Government Department, any statutory authority or other person, as
required by law.
The Contractor shall also maintain a register of complaints received in accordance with the activity and
manage the response to such complaints in accordance with a complaints management system which will
track the expeditious resolution of complaints.
Complaints which cannot be resolved in an efficient manner and in accordance with the requirements of the
CEMP shall trigger environmental monitoring where relevant and (where necessary) a review of the relevant
measures of the management plan to identify required improvements in order to address the complaints.
Complaints shall be made available to an administering authority for inspection as required by law,
3.5 Emergency and Contingency Plans
The site shall be appropriately managed to avoid detrimental impact upon the receiving environment external
to the site as a result of emergency situations such as periods of heavy or prolonged rainfall. The site shall
also be managed appropriately in the case of a halt in construction works due to unforeseen circumstances
in order to prevent adverse environmental impacts.
