DEVELOPMENT ASSESSMENT DELEGATED REPORT
Front Setback
Acceptable Outcome AO9.1 of the High Density Residential Zone Code requires buildings and
structures to be setback a minimum of 6m to the first two storeys and 10m to the third storey. The
proposal plans include 3 dwellings, two of which (House 1 and House 2) are considered 2 storeys
in height (due to the basement on the ground floor), whilst House 3 is considered 3 storeys in
height.
Houses 1 & 2
Houses 1 and 2 have frontage to Bottlebrush Ave only, and include the following setbacks:
• 4.6m to the Basement, Ground and First Floor levels (basement, first and second
storeys) (in lieu of 6m); and
• 8.8m (in lieu of 10m) to the roof terrace.
As such, the proposal does not comply with AO9.1 of the High Density Residential Zone Code.
The proposal is therefore required to comply with corresponding Performance Outcome PO9 of
the High Density Residential Zone Code, which states:
Buildings and structures are designed and sited to:
(a) provide a high level of amenity to users of the subject site and adjoining premises,
including provision of visual and acoustic privacy;
(b) not unreasonably obstruct views or cause overlooking of private open space or
habitable areas of adjoining premises;
(c) provide adequate distance from adjoining land uses;
(d) preserve existing vegetation that will help buffer development;
(e) allow for space and landscaping to be provided between buildings including adequate
area at ground level for landscaping with trees, shrubs, outdoor living and utilities;
(f) be consistent with the predominant character of the surrounding area; and
(g) protect the natural character and avoid adverse impacts on ecologically important
areas such as national parks, waterways and wetlands.
• The reduced setback on the Basement level relates to the front wall of the basement and the
opening. Conditions are included in the recommendation requiring landscaping to be provided
along the basement frontage, where possible.
• The reduced setback on the Ground level (first storey) relates to portions of both dwellings and
the balconies on both dwellings.
• The reduced setback on the First level (second storey) relates to portions of both dwellings
(including planter boxes) and the balconies on both dwellings.
