PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 8 DECEMBER 2015

3. ASSESSMENT
3.1. Instruments for Statutory Assessment
Under the Sustainable Planning Act 2009 the application must be assessed against each of
the following statutory planning instruments to the extent they are relevant to the
development:
    State Planning Policies;
    the South East Queensland Regional Plan;
 State Planning Regulatory Provisions; and
 the Planning Scheme for the local government area.
Of these, the statutory planning instruments relevant to this application are discussed in the
sections that follow.
3.2. State and Other Statutory Instruments
State Planning Policies
The proposal is consistent with the State Planning Policy and triggers further assessment
against the following Interim Development Assessment requirements.
State Interest - Biodiversity
The site is subject to regulated vegetation (Category B – assessable remnant vegetation)
located adjacent to the waterway. The applicant does not propose the removal of any
regulated vegetation outside of the detached house zone. The applicant proposes to
rehabilitate and transfer to Council the majority of the site (2.729ha), which will be reserved
for environmental purposes consistent with the requirements of the State Planning Policy.
State Interest – Coastal Environment
The site is included within the Coastal Management District, however the proposed
development will not impede on coastal processes and coastal resources. All the proposed
residential allotments are located 40m or more above the HAT (Highest Astronomical Tide)
inundation areas and the Department of Environment and Heritage Protection have
recommended approval of the proposal plans.
State Interest – Water Quality
Two bio-retention basins are located within proposed Lot 900 for the treatment of stormwater
run-off. The size and location of the devices will minimise any adverse impacts on the
environmental values of the receiving environment.
The lots are also proposed entirely above 5m AHD, while the eastern bioretention device is
located at 4m AHD. Although it is not anticipated that there will be more than 100m3 of
excavation works associated with works, an Acid Sulfate Soils Management Plan is required
prior to any construction works to avoid any disturbance of acid sulfate soils.
State Interest – Natural Hazards (Coastal Management)
All the proposed residential allotments are 40m or more above the HAT (Highest
Astronomical Tide) inundation areas and entirely above the 5m AHD level. The resultant
development will not remove or damage vegetation on coastal landforms and does not
require erosion control structures consistent with the Policy requirements. Furthermore, the
Department of Environment and Heritage Protection have recommended approval of the
proposal plans within the Coastal Management District.
South East Queensland (SEQ) Regional Plan 2009 – 2031 and Regulatory Provisions
The site is located within the Urban Footprint area of the SEQ Regional Plan and is
consistent with the Plan’s regional policies and Regulatory Provisions.
