GENERAL COMMITTEE MEETING AGENDA 16 MAY 2022 7. ASSESSMENT 7.1. Instruments for Statutory Assessment Under the Planning Act 2016 the application must be assessed against each of the following statutory planning instruments to the extent they are relevant to the development: State Planning Policy; South East Queensland Regional Plan; Coastal Protection and Management Regulation 2017; and Noosa Plan 2020. State Planning Policy The Noosa Plan 2020 is generally consistent with the State Planning Policy July 2017 (SPP) and the SPP raises no further issues relevant to the proposed development. South East Queensland (SEQ) Regional Plan The site is located within the Rural Living Area of the SEQ Regional Plan. The proposal is consistent with the regional policies of the SEQ Regional Plan. Planning Regulation 2017 The site is broadly identified as a Koala Priority Area. As the sites are in tidal areas and there will be no clearing of Koala habitat trees to allow the proposed development, this does not require further consideration. 7.2. Noosa Plan 2020 The following codes from the Noosa Plan 2020 are applicable to this development: Noosaville Local Plan Code Waterways Works Code The proposed works are identified as consistent with the scheme and are required to follow a code assessable application process. 7.3. Coastal Protection and Management Regulation 2017 The Coastal Protection and Management Regulation 2017 also applies to prescribed tidal works in a local government tidal area. The Project therefore requires assessment against Schedule 3 Code for Assessable Development that is prescribed tidal works. The proposed works are identified as consistent with the regulation and are required to follow a code assessable application process. 7.4. Assessment The attached report was prepared by Marine Approval Specialists to provide an assessment of the Project (OPW22/0029) against the Noosa Plan 2020 and the Coastal Protection & Management Regulation 2017. Background information provided to Marine Approval Specialists included all applicant material submitted to Council as the Assessment Manager. An assessment of relevant codes of the Noosa Plan 2020 and the Coastal Protection & Management Regulation 2017 was completed. The assessment found that the Project satisfactorily complies with relevant codes and recommends that the Project is approved subject to conditions. The Code for Assessable Development that is Prescribed Tidal works is the primary instrument for assessing the proposed works. The Project demonstrates compliance with the code by: Proposing habitat restoration works that are compatible with the character and amenity of the Noosa River and surrounds; Installing signage and navigation aids consistent with MSQ requirements; Page 47 of 96
