Town Planning Report - 3 Grady Street Kin Kin
An assessment of the relevant codes and assessment benchmarks has been completed below.
6.2 Community Facilities Zone Code
The purpose of the Community Facilities Zone is to accommodate a diverse range of community-
oriented uses, activities and infrastructure, whether delivered through public or private ownership.
This includes key services such as educational establishments, hospitals, transport and
telecommunication networks, and essential utility installations. The zone also supports residential
uses where all dwellings, other than caretaker’s accommodation, form part of an affordable housing
component and are located on land either associated with, or owned, controlled or managed by, an
entity undertaking a community activity such as a community care centre, place of worship or
residential care facility.
The implementation of Planning Scheme Amendment No. 2 on 26 September 2025, amended Table
5.5.11 and specifically identified the subject land as being suitable for a dwelling house. In this
instance, the use of the land for a dwelling is therefore consistent with the Community Facilities Zone.
The key performance outcomes of the Community Facilities Zone Code are discussed below.
Role and Function
Relevant Performance Outcomes:
• PO1 - The use of the land for a dwelling is considered to be a special residential use in the
circumstances and therefore complies with PO1.
• PO2 - The proposed development seeks to maintain the ongoing provision and use of
Community Facilities zoned land despite not being for community related purposes. This is
achieved through the provision of maintaining the existing built form and façade addressing 50
Main Street, Kin Kin (Lot 214 on SP143420), which is a public space that includes the Kin Kin
School of Arts, tennis courts, and community park.
• PO3 – Despite the land remaining in the Community Facilities Zone and being annotated Precinct
4 – Place of Worship, the planning scheme has been deliberately amended to allow for a dwelling
on the subject land. Despite this, the use is not consistent with the specific purpose annotated
on the zoning map.
• PO5 - The proposal seeks to establish a dwelling house and secondary dwelling, which remains
consistent with the surrounding land uses, primarily consisting of low density residential zoned
land containing existing dwellings. The proposal complies with PO5.
Built Form:
• PO17 & AO17 - The proposed dwelling does not seek to increase the height of existing church
building, which is less than 8 metres from natural ground level (NGL). The proposed secondary
dwelling is also less than 8m in height with all buildings being single storey in height. The
proposed development is low rise and will have a visual bulk and architectural scale consistent
with the character of the area. The development complies with PO17.
