GENERAL COMMITTEE MEETING AGENDA 13 JANUARY 2020

The applicant is seeking a 50% reduction of application fees for the change to the original DA
application.
The application is for a proposed equipment shed at the Noosa Rugby Union Club grounds. The rugby
club has a lease on the Council owned property.
As per Noosa Council Policy – any non-profit, volunteer, charitable, community, sporting, religious
organisation not in possession of a permanent liquor or gaming licence is eligible for 50% reduction in
development application fees – Noosa Rugby Union holds a Community Club Liquor Licence, Licence
No 83359, which is a Liquor Licence for a Sporting Club which is run by volunteers, and does not have
any permanent full-time bar staff or gaming machines so conditions do apply to this licence.
It is suggested that the 50% reduction of fees would be reasonable as the equipment shed is proposed
to secure the maintenance equipment used to enhance and maintain the rugby ovals.

$22,824.00
The application is for a 33m² ancillary tasting bar within an approved building. The applicant has
requested a fee reduction from the prescribed fees and charges.
The applicant feels this fee is exorbitant and not justified. The applicant states: ‘In accordance with s97
of the Local Government Act, development application fees are supposed to be levied on a cost-
recovery fees. S97(4) states that a cost-recovery fee must not be more than the cost to the local
government of taking the action for which the fee is charged.’
The applicant suggests the base fee should be calculated on the basis of the actual 33 m² proposed.
This would equate to $101.44 per m² of GFA which equals $3,347.52. The x3 multiplier could be applied
(3,347.52 x 3 = 10,042.56) and then the 25% discount applied for use within an approved building =
$7,531.92
The use is inconsistent and impact assessable in the Industry Zone and therefore subject to a multiplier
of 3.
While the application will require a significant time to assess the application being an inconsistent use,
the use area proposed is relatively minor and ancillary to the approved industrial use on site.
