         Condition 4 of the development approval (132005.1133.5) over Precinct F for “Parkridge Noosa”
         states:

         The ancillary shop, restaurant/cafe, multi-function room, gym and other ancillary facilities shall be
         operated and maintained as a Resort. A letting pool service promoting and managing short term
         accommodation must also be established on site and made available to all owners of multiple
         dwelling units. The community management statement for any or all bodies corporate having
         control of the Resort or any part thereof shall incorporate this condition. Where the development is
         staged, the common resort facilities must be completed and operational as part of the first stage or
         after construction of the 64th Unit.

         While the above condition has been imposed on the development approval, there is effectively
         no requirement for the dwelling units to be used only for visitor accommodation. From a town
         planning perspective, “Parkridge Noosa”, while a quality development, will not deliver the short
         term visitor accommodation expected under the former Noosa Springs POD or under the current
         Noosa Plan 2020.

         The “Parkridge Noosa” development is located on an elevated part of the existing Noosa Springs
         development to the south and west of Noosa Springs Drive. The existing multiple dwellings are
         contained in a number of buildings spread across and below the ridgeline with the more elevated
         dwelling units mostly protruding above the tree line and having direct views of Lake Weyba.

         In terms of elevation, the highest building within the “Parkridge Noosa” development to the north
         has a reduced level (RL) of 44.40 (AHD) whereas the highest building within the proposed
         “Boutique Hotel” development is RL 41.17m (AHD) (refer, Figure 3, below).

         Development Proposal

         The proposed development provides for a “Boutique Hotel” over part of the subject land as shown
         in Figure 4, below. It is intended that the “Boutique Hotel” provide high quality visitor
