             a) tourist and visitor accommodation that includes integrated leisure facilities (examples of
                integrated leisure facilities — bars, meeting and function facilities, restaurants, sporting and
                fitness facilities) or;
             b) staff accommodation that is ancillary to the use in paragraph (a); or
             c) transport facilities for the premises (a ferry terminal or air service, for example)

         The other uses being applied for include a Food and Drink Outlet for the proposed café and bar
         area as well as Outdoor Sport and Recreation for the proposed three tennis courts.

         Under the Table of Assessment for the Tourist Accommodation Zone (Table 5.5.4), a Resort
         Complex is a consistent use; however, is subject to impact assessment. Under the Table of
         Assessment (Table 5.5.16) for the Recreation and Open Space Zone not surprisingly a Resort
         Complex is an inconsistent use and subject to impact assessment.

         The proposed Food and Drink Outlet is ancillary to the Resort Complex and will primarily be used
         by guests of the “Boutique Hotel”; however, the Council has insisted that this ought to be treated
         as a separate use. While the proposed tennis courts will also form part of the Resort Complex, the
         tennis courts will be used independently by third parties, such as members, Noosa Springs
         residents and for tennis coaching and lessons, as is currently the case. The Outdoor Sport and
         Recreation use is a consistent use in the Recreation and Open Space Zone. The application as a
         whole is subject to impact assessment.

         It is noted a portion of the proposed Resort Complex is located within the Tourist Accommodation
         Zone as shown in Figure 7, above. It is also noted under the Table of Assessment for the Open
         Space Recreation Zone, some related uses such as Nature-based tourism and a Tourist park are
         consistent uses in this zone, which are uses to be enjoyed by visitors to the Noosa area.
