capacity over the site (29 cars parked in total – representing 18.8% utilisation). While the report noted that 21% of the medical facilities were untenanted at the time of the survey, it concluded that the anticipated parking demand, including that of the future tenancies, remains within the approved parking numbers. Overall, the proposal presents a low-impact, complementary use that aligns well with the Noosa Business Centre’s mixed-use character and makes efficient use of existing infrastructure without generating additional car parking issues. Given the parking rate under the Planning Scheme for Indoor Sport and Recreation (1 space per 20m2) is the same as Health Care Service (1 space per 20m2) and therefore the proposed use does not create any additional demand. 5. Statutory Planning Overview 5.1 State Framework Planning Act 2016 The Planning Act 2016 is the main legislative framework used by Local Council’s to assess development applications. This proposal has been submitted as a Impact Assessable application under Section 51 of the Act. State Planning Policy The State Planning Policy (SPP) from July 2017 is already incorporated in the Noosa Plan 2020, hence a separate assessment against the SPP is not required. Referral Agencies and State Development Assessment Provisions The proposal has been checked against Schedule 10 of the Planning Regulation 2017. Since the Indoor Sport and Recreation use will be within an existing building, with no external changes, and no referral triggers are identified in the Development Assessment Mapping System, the State Development Assessment Provisions do not apply. As a result, no referral to the State Assessment and Referral Agency (SARA) is required. South East Queensland Regional Plan 2017 The South East Queensland Regional Plan 2017 (SEQRP) provides direction for development in the region. This framework will be used to manage the development, growth of the area and overall change of land use. The proposal site is located within the Urban Footprint, therefore does not trigger referral to SARA, and no further assessment is needed. 5.2 Local Framework Noosa Planning Scheme 2020 Strategic Framework
