GENERAL COMMITTEE MEETING AGENDA 15 NOVEMBER 2021 6 RAL20/0019 – PLANNING & ENVIRONMENT COURT APPEAL NO. D116 OF 2021 – REFUSAL OF AN APPLICATION FOR RECONFIGURING A LOT – 1 LOT INTO 2 LOTS AT 23 JIRRIMA CRESCENT, COOROIBAH Author Manager Development Assessment, Kerri Coyle Environment & Sustainable Development Department Index ECM/ Application/ RAL20/0019/ Case/ Carlyle Attachments 1. Amended Proposal Plans EXECUTIVE SUMMARY This report reviews and recommends settlement of an appeal against Council’s decision to refuse an application to subdivide 23 Jirrima Crescent, Cooroibah from 1 lot into 2 rural residential lots. The application was refused by Council primarily due to the proposed lot boundary traversing an identified riparian buffer. During the course of the appeal advice was sought from an aquatic ecological consultant who considered that the Noosa Plan 2020 riparian buffer width was not reflective of the area’s environmental values, also as the lot boundary followed an existing cleared pathway, the proposed subdivision could facilitate overall an improvement to the riparian buffer. Accordingly, following mediation, the applicant prepared a revegetation concept plan for the site, including weed removal and rehabilitation. A revised plan of subdivision was also provided identifying a proposed building envelope clear of the riparian buffer area. The proposed revegetation concept plan and revised plan of subdivision is acceptable and accordingly it is recommended that the appeal be settled.
