EXECUTIVE SUMMARY
This report provides a tender evaluation summary and recommendation for the tender
award for the external supply of traffic control services utilising a schedule of rates.
The current contract for traffic control services is due to expire on 21 November 2021.
In accordance with Council procurement policy and procedure, an Invitation to Tender
(ITT) was initiated and attracted 11 responses with 10 considered compliant for further
assessment.
The tender evaluation panel completed the evaluation process and considered the
tender submitted by Traffic Management People Pty Ltd ATF the Abrahamson Family
Trust t/as Traffic Management People to be the most advantageous to Council.
However, prior to consideration for award at Council’s Ordinary Meeting of 21 October
2021, Traffic Management People Pty Ltd advised Council that it had sold its traffic
management business to a new entity, Traffic Management People No.2 Pty Ltd, and
that it had transferred all of its personnel, operations and offices to the new entity.
As such, at Council’s Ordinary Meeting of 21 October 2021, Council resolved to defer
the tender award to enable the CEO to provide advice at a future Council meeting
regarding finalising this tender.
Council’s Procurement Team reviewed the tender as a result of the circumstances above
and subsequently formed the view that the tender from Traffic Management People Pty
Ltd ATF the Abrahamson Family Trust t/as Traffic Management People could not be
accepted (as that entity could no longer provide the services as tendered) and that the
new entity Traffic Management People No.2 Pty Ltd could not be considered under this
tender process as it had not submitted a tender.
Subsequently the tender evaluation panel reconvened to consider its initial
recommendation in light of the above, and as a result the panel concluded that, of the
submitted tenders capable of acceptance, the tender from Verifact Traffic Pty Ltd was
the most advantageous to Council, presenting the best value for money.
RECOMMENDATION
That Council note the report by the Acting Civil Operations Manager to the General Committee
Meeting dated 15 November 2021, and
A. Award Contract No. T000048 for the provision of Traffic Control Services to Verifact
Traffic Pty Ltd for a period of two (2) years commencing on 22 November 2021; and
B. Subject to satisfactory performance by Verifact Traffic Pty Ltd, authorise the CEO to
approve the options to extend the contract at the expiry of the first two (2) year term for
a further three (3) terms of up to 12 months each ending 21 November 2026.
