SECTION 1
LEGAL REQUIREMENTS (WORK HEALTH AND SAFETY MANAGEMENT PLANS)
Principal Contractor duties for Work Health and Safety (WHS) Management Plans
The Principal Contractor is responsible for preparing a written Work Health and Safety (WHS) Management Plan (the Plan) for all
projects where the value of construction work exceeds $250,000. The Plan must be prepared before work on the project starts and
reviewed and amended where necessary to reflect the changing site conditions.
The plan should also take into consideration, all aspects of any designer's report, where provided for the building, formwork
scaffolding or any ancillary structure. The reports should address the health and safety aspects of any atypical features of the
design.
The Principal Contractor must be appointed by the owner of the workplace where construction work is to be undertaken.
Although there is no longer any requirement to notify Workplace Health and Safety Queensland (WHSQ) of the appointment on an
approved form, a written record of the appointment should be retained by both the builder and client.
The Principal Contractor also has a duty to ensure, so far as is reasonably practicable, that each person who is to carry out
construction work in connection with the project is made aware of:
The content of the Plan; and
The person’s right to inspect the Plan and any revision of the same.
A copy of the Plan should be kept on site at all times, or otherwise made readily available for those carrying out work on the project
(e.g. an electronic copy on a computer).
Under Section 309 of the Work Health and Safety Regulation 2011, a Principal Contractor's WHS Management Plan must include:
The names, positions and health and safety responsibilities of all persons at the workplace whose positions or roles involve
specific health and safety responsibilities in connection with the project;
The arrangements in place, between any persons conducting a business or undertaking at the workplace where the
construction project is being undertaken, for consultation, cooperation and the coordination of activities in relation to
compliance with their legal duties;
The arrangements in place for managing any work health and safety incidents that occur;
Any site-specific health and safety rules, and the arrangements for ensuring that all persons at the workplace are informed
of these rules; and
The arrangements for the collection and any assessment, monitoring and review of safe work method statements at the
workplace.
Relevant information in this plan must be communicated by each subcontractor to all their workers before they start work. A
completed toolbox meeting record (see Supporting documents) must then be provided to the Principal Contractor by each
subcontractor, confirming that each worker is aware of the details of the plan. The plan will also be used as the basis of a site
specific induction for each worker when they commence work at the work site.
The subcontractor must sign and return the Subcontractor Declaration form (see Supporting documents) and return it to the
Principal Contractor prior to commencing work on site.
