Planning Assessment Report Page 11 300 Kennedys Road, Lake Macdonald QLD 4563 – Extractive Industry 3.2 Nearby Residences A residential use is identified on Lot 1 on RP127728, which shares the Lake Macdonald Drive access to the Site. The Traffic Impact Assessment Report (ATTACHMENT 7) prepared for the Site anticipates that the residential driveway will not be adversely impacted upon by the proposed development. The proposed disturbance areas on the Site (on Lot 3 on SP108094) are located a considerable distance (i.e. 850 m) from this residence, and it is anticipated that the residence will not be significantly impacted upon. In addition, the haulage route (along Lake Macdonald Drive) between the Site and the mining leases to be rehabilitated to the south of the Site (at Neales Quarry and White Pit Quarry) comprise residential uses on both sides of the road and adjacent to Neales Quarry and White Pit Quarry. Refer to FIGURE 1 – SITE LOCATION PLAN and FIGURE 2 – SITE AND SURROUNDS. Although there are residential uses located in the vicinity of the receiving mining leases to be rehabilitated (ie. along Lake Macdonald Drive and adjacent to Neales Quarry and White Pit Quarry), it is anticipated that the residential uses will not be impacted upon as a result of the proposed development. Extractive industry operations on-site will be guided by a Site Based Management Plan, which provides a framework for environmental management on-site and is a practical guide at the operational level to contain environmental impacts including noise and air quality management procedures (refer ATTACHMENT 8 – SITE BASED MANAGEMENT PLAN). Noise and dust control measures will be employed to maintain environmental values and standards in accordance with relevant regulations, policies and conditions. In addition, buffers between operations and adjacent residents / residential areas will be maintained. Transport drivers will be instructed in requirements for appropriate behaviour on public roads. 3.3 Statutory Process 3.3.1 Sustainable Planning Act 2009 The Sustainable Planning Act 2009 (“SPA”) took effect on 18 December 2009 and is the principal regulatory framework for planning land use and assessing development proposals in Queensland. Under SPA “Development” is defined as any of the following: (a) carrying out building work; (b) carrying out plumbing or drainage work; (c) carrying out operational work; (d) reconfiguring a lot; (e) making a material change of use of premises. A “material change of use of premises” means: (a) generally (i) the start of a new use or premises; or (ii) the re-establishment on the premises of a use that has been abandoned; or (iii) a material change in the intensity or scale of the use of the premises. (b) For administering IDAS in relation to an environmentally relevant activity, other than for an agricultural ERA under the Environmental Protection Act, section 75, a mining activity, a chapter 5A activity or a mobile and temporary environmentally relevant activity – (i) the start of a new environmentally relevant activity on the premises; or (ii) an increase in the threshold of an environmentally relevant activity on the premises; or (iii) the re-establishment on the premises of an environmentally relevant activity that has been abandoned; or (iv) a material increase in the intensity or scale of an environmentally relevant activity on the premises. The proposal falls within the definition of “development” as defined under SPA and constitutes a “Material Change of Use”. December 2012 / file ref. 1271_DA1_310_001 GROUNDWORK p l u s
