PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 25 MARCH 2014 3 LOCAL GOVERNMENT ASSESSMENT ROLES The application is unique in that it straddled local government boundaries affected by the recent Council de-amalgamations. The Local Government and Other Legislation Amendment Act 2013 dealt with this scenario and the ongoing assessment roles of the Sunshine Coast Council and Noosa Council. In accordance with Part 5 - Amendment of Sustainable Planning Act 2009, on 2 January 2014 Sunshine Coast Council decided that Noosa Council would become the Assessment Manager for the application. Consequently, under Section 952 (10), Sunshine Coast Council became a concurrence agency for the application in relation to the part of the development within its local government area. Details of their concurrence response are provided in the consultation section of this report. The assessment material, internal and external consultant expert reports and advice have been common to both Councils’ assessments. Corresponding text is, therefore, common to both the Sunshine Coast Council’s concurrence assessment report and this report. 4 SITE DETAILS 4.1 Background/Site History Three development approvals of note have previously been issued for the site, as follows: Property Approval Details Description 191 Hollett Rd A rezoning application was approved over the site on 1 August 1997, Noosaville approving a change of the site’s zoning to Special Residential and (Lot 53 permitting the development of a maximum of 80 rural residential lots and 2 SP163571) rural lots. This rezoning was gazetted in 1 May 1998. The associated Plan of Development established footprints for future development and open space areas. It also established the development parameters for the site, including lot density and lot size. The rezoning & Plan of Development were superseded with the adoption of The Noosa Plan in 2006. 108 – 142 Development Permit for Rural Holiday Accommodation (24 villas) approved Tidswell Rd, via Court Order on 16 August 2004 for Planning & Environment Court Weyba Downs Appeal No.4676 of 2012 – G N & J D Mantle vs Sunshine Coast Council. (Lot 11 The approval is for rural holiday accommodation in the form of a resort and SP250714) spa complex comprising 24 villas, reception area, restaurant, spa, pool, meeting room and a 3 bedroom manager’s residence. A maximum of 108 persons are allowed to occupy the site at any one time. A copy of the approved plan is included as Attachment 5. The Sunshine Coast Council refused the most recent application to extend the approval on the basis that the approval failed Sustainable Planning Act tests for consistency with current planning provisions, level of community awareness and the present likelihood of submitters objecting to the development. An appeal against that decision was lodged on 30 November 2012 and is currently ongoing. Page 94 of 231
