4.4 Dual Occupancy and Multiple Dwelling Code
The Overall Outcomes of the Dual Occupancy and Multiple Dwelling code are to ensure dual
occupancies are of a high-quality design with respect to the local character, built form & amenity of
the local plan area. Dual occupancies are a consistent use within the District Centre Zone, where in
conjunction with a mixed-use format and where neither dwelling has a gross floor area exceeding
100m2.

The existing retail uses on the ground level of the building support the mixed-use format of the
development. Minor enhancements to the upper-level balcony create privacy and amenity for
residents and street users with respect to the local character of the local plan area. The development
is consistent with the relevant outcomes of the Dual Occupancy and Multiple Dwelling Code.

An assessment against each of the relevant performance and acceptable outcomes are included in
Appendix 3. with further comment provided below.

Private Open Space

       PO11
       Private open space:
           (a) is provided to all dwellings and is adequate in size, shape and dimensions to suit the needs
               of the occupants;
           (b) receives adequate sunlight; and
           (c) is designed and orientated to ensure privacy is maintained between uses.

       AO11.1
Private open space is provided for each dwelling at the following rate:
at ground level—a minimum of 25m² directly accessed from living spaces; or
if above ground level—12m² with a minimum width of 2.5 metres accessed directly from the living
       spaces.

       OR

       AO11.2
Private open space is provided for each small dwelling at the following rate:
at ground level—a minimum of 20m² directly accessed from living spaces and exclusive of clothes
       drying area; or
if above ground level—9m² with a minimum width of 2.5 metres accessed directly from the living
       spaces

       AO11.3
Private open space contributing to the above calculations has a maximum gradient of 10% (1 in 10)
and is clear of any utilities such as gas, water tanks and air conditioning units.

Although the development does not meet the Acceptable Outcome for 2.5m minimum width of
balconies (provided 2m as shown in Figure. 3 above), the existing balcony is 12m2 and provides
sufficient private outdoor living space for the residents. The balcony is orientated to the north
receiving adequate sunlight and designed with privacy screens to maintain privacy for residents. The
proposed re-use of the upstairs tenancy does not limit the business opportunities on ground level -
consistent with the Performance Outcome PO11.
