Under the interim development assessment provisions, the following parts are relevant:

State interest – water quality for receiving waters:
While collectively the subject land would be greater than 2,500m², which could involve an
impervious area greater than 25% of the net developable area; however, the allotments are
already improved by Eco-Cabins and the matter of water quality has been dealt under the
previous development approvals. The development as constructed minimises adverse
impacts on the environmental values of receiving waters by complying with the SPP Code
for Water Quality.

State Interest – Natural Hazards, Risk and Resilience:
While the subject land is designated as potentially being in a local government flood
affected area, according to the overlay mapping under the planning scheme, the subject
land is not affected by flooding.

The land is mapped as being subject to a Medium Potential Bushfire Intensity. While this is
the case, the land has been developed for Eco-Cabins having been already constructed
within the allotments. Consequently, the risk from bushfire has previously been considered
and is no greater given no building work is being proposed. The change of use allowing for
a Detached House within the allotments makes no material difference to the issue of
bushfire.


6. Noosa Plan 2006

Under the Noosa Plan the subject land is located in the Noosa North Shore Locality and is
included in the Visitor Mixed Use Zone (refer Figure 5).


The applicant seeks to allow 19 of the existing Eco-Cabins to be used for Detached Housing. A
Detached House is defined as:

Detached house means the use of premises for a single dwelling unit which comprises the whole of the
building on one lot. The term includes uses and works incidental to and associated with the detached
house. The term includes the temporary use as a display home or removal home. The use is not divided
further.

The current use of the land is for visitor accommodation as defined under the preliminary approval.
Visitor accommodation as defined by the Noosa North Shore Eco-Tourism Portal, stated that:

Visitor accommodation means dwelling units or accommodation units that are designed and
predominantly used for short term visitors to the locality, with no persons permitted to occupy the
site for the purposes of permanent accommodation, excluding those persons in manager’s
residences.
